  • How the modern Supreme Court might look at the 14th Amendment and birthright citizenship

    In the few days since he returned to the White House, President Donald Trumpā€™s sweeping executive orders and mass pardons have shattered political and legal norms. But one order is in a category of its own.

    His decree proposing to end the constitutional promise of birthright citizenship contradicts the plain words of the 14th Amendment and would reverse an 1898 Supreme Court milestone. That case, brought by the son of Chinese nationals, has long guaranteed citizenship for anyone born in the United States, unless the parents fall under such narrow exceptions as foreign diplomats or soldiers of invading armies.

    The Trump directive recalls the era of Dred Scott v. Sandford, the infamous 1857 decision that said Black people could not be citizens. That case, which helped precipitate the Civil War, was reversed by ratification of the 14th Amendment in 1868.

    Perhaps to counteract comparisons with a reviled decision that rested on notions of White supremacy, the executive order referred to Dred Scott at the outset, calling it a ā€œshameful decision.ā€ But then the directive recast the 14th Amendment to befit Trumpā€™s anti-immigrant mission and to exclude children born to undocumented parents.

    Immigrant-rights advocates, civil libertarians and 24 Democratic-led states and cites immediately filed a series of lawsuits. On Thursday, a Ronald Reagan-appointed federal judge in Seattle issued a temporary restraining order against Trump, calling the executive order ā€œblatantly unconstitutional.ā€

    The challenges set the stage for a court confrontation over a central tenet of American identity and assurances woven into life here for more than a century.

    The litigation is likely to reach the Supreme Court, where Dred Scott has long been regarded as a great ā€œself-inflicted wound.ā€ But a new conservative supermajority has given Trump supporters hope that it might eventually reverse yet another precedent.

    This one would be different.

    Trumpā€™s view of the 14th Amendment conflicts with the clear text and a legal interpretation more than a century old. And in contrast to other areas of policy and individual rights, the justices have not signaled any desire to revisit United States v. Wong Kim Ark.

    Unlike landmarks like Brown v. Board of Education, New York Times v. Sullivan and Roe v. Wade, Wong Kim Ark and birthright citizenship never became flashpoints at justicesā€™ Senate confirmation hearings. Nor has birthright citizenship become part of the daily political discourse the way abortion has. And unlike the guarantee of privacy and other fundamental rights implicit in the Constitution, the Citizenship Clause of the 14th Amendment is explicit.

    It states: ā€œAll persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.ā€

    Another factor distinct to this moment: The current Supreme Court majority takes an ā€œoriginalistā€ approach, and the history and tradition underlying the 14th Amendment and the 1898 case would make reversal of Wong Kim Ark difficult to justify.

    Writing last year in the Georgetown Immigration Law Journal, Professor Sandra Rierson said the expansive text of the 14th Amendment, including the phrasing regarding jurisdiction, ā€œhad a clear and long-standing meaning under the common law that existedā€ when the Amendment was adopted, and ā€œthat meaning was reiterated and explained throughout the congressional debates.ā€

    Rierson, whose essay traced the proliferation of proposals to end birthright citizenship, observed that modern opposition has arisen ā€œin the context of escalating hostility towards immigrants, especially non-white immigrants.ā€

    After Trump issued his order this week, Rierson, who teaches at Western State College of Law in California, posited that the conservative justices who control the court would, based on their own reasoning, be unlikely to reverse precedent.

    ā€œIf what theyā€™re really concerned about is history and tradition in the United States,ā€ she told CNN, it would be difficult to accept Trumpā€™s executive order.

    ā€œWong Kim Ark came out at a time of anti-immigrant phobia that certainly rivals what we have today,ā€ she added. ā€œItā€™s not that the justices didnā€™t understand hostility toward immigration. ā€¦ Politicians have always exploited the fear of the other.ā€

    During the 1890s, anti-immigrant fervor was particularly directed at the Chinese. The case began when Wong Kim Ark, at roughly age 21, left America to visit relatives in China; upon his return, he was denied entry, on grounds that he lacked US citizenship.

    In its 1898 ruling, the Supreme Court majority said the plain words of the 14th Amendment protected the son of Chinese nationals who was born in the United States.

    ā€œThe Amendment, in clear words and in manifest intent, includes the children born, within the territory of the United States, of all other persons, of whatever race or color, domiciled within the United States,ā€ Justice Horace Gray wrote for the majority. ā€œEvery citizen or subject of another country, while domiciled here, is within the allegiance and the protection, and consequently subject to the jurisdiction, of the United States.ā€

    The court concluded, ā€œTo hold that the Fourteenth Amendment of the Constitution excludes from citizenship the children, born in the United States, of citizens or subjects of other countries would be to deny citizenship to thousands of persons of English, Scotch, Irish, German, or other European parentage who have always been considered and treated as citizens of the United States.ā€ The court noted that Wong Kim Arkā€™s parents had at the time ā€œa permanent domicil and residence in the United States,ā€ yet the court did not condition its interpretation of the 14th Amendment on that fact.

    The series of lawsuits that have been filed since Monday emphasize the potential harm to individual people under Trumpā€™s order.

    ā€œBabies are being born today here, and in the plaintiff states and around the country, with a cloud cast over their citizenship,ā€ a lawyer for the state of Washington said in court Thursday.

    Nationally, according to the complaint from four Democratic-led states in Seattle, in 2022, ā€œthere were approximately 255,000 births of citizen children to non-citizen mothers without lawful status (undocumented) and approximately 153,000 births to two undocumented parents.ā€

    The filing outlines the consequences for children who would lose eligibility for vital benefits and social services. Adults would be unable to obtain Social Security numbers and work lawfully. And they would not be able to vote. Overall, the claim asserts, the newly affected individuals ā€œwill be placed into lifelong positions of instability and insecurity as part of a new underclass in the United States.ā€

    Since Trump first ran for the presidency in 2016, he has railed against birthright citizenship. During his 2024 campaign he vowed that on Day One of a second term, he would order an end to birthright citizenship, which he insisted was ā€œbased on a historical myth and a willful misinterpretation of the law.ā€

    Monday, after again taking the oath of office from Chief Justice John Roberts, Trump laid out his order called ā€œProtecting the Meaning and Value of American Citizenship.ā€

    He opened by stating that ā€œThe privilege of United States citizenship is a priceless gift.ā€ He said Dred Scott misinterpreted the Constitution ā€œas permanently excluding people of African descent from eligibility for United States citizenship solely based on their race.ā€

    Then he asserted: ā€œBut the Fourteenth Amendment has never been interpreted to extend citizenship universally to everyone born within the United States. The Fourteenth Amendment has always excluded from birthright citizenship persons who were born in the United States but not ā€˜subject to the jurisdiction thereof.ā€™ā€

    Rejecting the entrenched understanding of the Citizenship Clause, Trump set out two new categories of individuals born in the US who would not be covered: those whose mother was unlawfully present in the US and whose father was not a US citizen or lawful permanent resident at the time of the childā€™s birth; and those whose mother was in the US on a lawful but temporary visa (such as a student or tourist visa) and whose father was not a US citizen or lawful permanent resident at the time of the birth.

    He said his January 20 order would take effect in 30 days.

    Trumpā€™s limitation on the 14th Amendment echoes legal theories, previously on the fringe, that the phrase ā€œsubject to the jurisdictionā€ of the US would not reach undocumented immigrants.

    Former Chapman Law professor John Eastman, one of the most prominent critics of birthright citizenship and a strategist behind Trumpā€™s failed challenge to the 2020 election results, argued the 14th Amendment covered individuals subject to ā€œcompleteā€ political jurisdiction with no allegiance elsewhere.

    ā€œJustice Gray simply failed to appreciate ā€¦ that there is a difference between territorial jurisdiction and the more complete, allegiance-obliging jurisdiction that the Fourteenth Amendment codified,ā€ Eastman wrote in the University of Richmond Law Review, contending the 1898 court wrongly construed the ā€œjurisdictionā€ restriction to cover a discrete category such as the children of diplomats.

    Eastman argued the majority opinion in Wong Kim Ark was also ā€œat odds withā€ principles underlying the sovereign power of naturalization. ā€œWhat it meant, fundamentally, was that foreign nationals could secure American citizenship for their children unilaterally, merely by giving birth on American soil, whether or not their arrival on Americaā€™s shores was legal or illegal, temporary or permanent.ā€

    Roger Taney and the infamous Dred Scott

    No current cases would support Trumpā€™s position on birthright citizenship. Yet traces of his rhetoric about immigrants ā€œinvadingā€ America surfaced last year in an opinion by US Appeals Court Judge James Ho that could, perhaps, eventually be used to advance the presidentā€™s stance.

    In a concurring opinion in a dispute unrelated to birthright citizenship, Ho, a 2018 Trump appointee on the federal appellate court covering Texas, Louisiana and Mississippi, was receptive to arguments that illegal immigration at the Texas border could constitute an ā€œinvasion.ā€ That language could evoke an exception to the established 14th Amendment interpretation, for children of invading armies.

    Judge Ho has often reinforced emerging conservative theories. Before joining the bench, however, he wrote an essay directly addressing birthright citizenship and said the 14th Amendment and Wong Kim Ark case protected children of undocumented immigrants.

    ā€œAll three branches of our government ā€“ Congress, the courts, and the Executive Branch ā€“ agree that the Citizenship Clause applies to the children of aliens and citizens alike,ā€ he said in a 2006 essay in The Green Bag.

    Ho concluded with a warning if a move were made to withdraw birthright citizenship: ā€œStay tuned: Dred Scott II could be coming soon to a federal court near you.ā€

    Chief Justice Roberts received no questions about the Wong Kim Ark case during his 2005 Senate confirmation hearings. But Dred Scott was raised, and Roberts responded by calling it, ā€œperhaps the most egregious examples of judicial activism in our history ā€¦ in which the Court went far beyond what was necessary to decide the case.ā€

    ā€œAnd really, I think historians would say that the Supreme Court tried to put itself in the position of resolving the dispute about the extension of slavery, and resolving it in a particular way that it thought was best for the Nation,ā€ he added. ā€œAnd we saw what disastrous consequences flowed from that.ā€

    Since then, Roberts has also alluded to Dred Scott in terms of his own legacy.

    ā€œYou wonder if youā€™re going to be John Marshall or youā€™re going to be Roger Taney,ā€ he said in 2010, contrasting the great 19th century chief justice with the chief justice who wrote Dred Scott.

    ā€œThe answer is, of course, you are certainly not going to be John Marshall,ā€ Roberts said. ā€œBut you want to avoid the danger of being Roger Taney.ā€

    WEST LAFAYETTE, Ind. (AP) ā€” Freshman Avery Howell scored a season-high 18 points, JuJu Watkins added 16 points and seven rebounds and No. 4 Southern California nearly pitched a second-quarter shutout as it routed Purdue 79-37 on Wednesday.

    The Trojans (18-1, 8-0 Big Ten) allowed just two points in the second quarter en route to their 14th consecutive win. Four conference victories have come by 20 or more points.

    Kendall Puryear led Purdue (7-12, 0-8) with 10 points as the Boilermakers lost their seventh straight. Purdue has losses to each of the top four teams in The Associated Press Top 25.

    Destini Lombard scored all eight of her points in the first four minutes as the Boilermakers jumped to a surprising 16-10 first-quarter lead.

    But the Trojans responded with a 31-0 run that didnā€™t end until Jordyn Poole beat the shot-clock buzzer with a mid-range jumper at the 1:57 mark in the second quarter. Southern Cal still led 46-18 at halftime, and Purdue never recovered.

    No. 6 UCONN 100, VILLANOVA 57

    STORRS, Conn. (AP) ā€” Paige Bueckers had 21 points, eight rebounds and nine assists in just three quarters to help No. 6 UConn rout Villanova.

    Sarah Strong had 22 points and Kaitlyn Chen added a season-high 17 for the Huskies (18-2, 9-0 Big East). They have won 29 straight conference regular-season games.

    Jasmine Bascoe had 15 points for Villanova (10-10, 4-4). Maddie Burke and Maddie Webber each added 11.

    Bueckers had 19 points in the first half, nine in a 3:43 span. UConn had runs of 12-0, 10-0 and 10-0 in the half and led 58-32 at the break.

    With the Huskies leading by 42 points at the end of the third quarter, none of the starters played in the fourth quarter. A basket by freshman Allie Ziebell with 2:38 left to play made it 100-54 as the Huskies had their second 100-point game of the season.

    OKLAHOMA ST. 60, No. 9 TCU 59

    STILLWATER, Okla. (AP) ā€” Stailee Heard scored 17 points, Jadyn Wooten scored 10 of her 14 in the fourth quarter, and Oklahoma State rallied to beat No. 9 TCU, ending the Horn Frogsā€™ 10-game winning streak.

    Anna Gret Asi added 10 points for Oklahoma State (16-3, 6-2 Big 12), which trailed by 15 points at halftime, cut the lead to eight after three quarters, then outscored the Cowgirls 20-11 in the final period.

    It was the Cowgirlsā€™ first win over a top-10 opponent since defeating No. 7 UCLA on Dec. 8, 2017.

    Heardā€™s 3-pointer with 1:12 left gave Oklahoma State a 58-55 lead. Asi added two free throws to make it 60-55 with 20.7 left. But the Cowgirls missed four free throws and TCU made four straight foul shots to pull the Frogs to within 60-59.

    Jalyn Brown scored 12 points for the Sun Devils (8-12, 2-6), who have lost five straight. Kennedy Fauntleroy added 14 points and seven rebounds and Jyah Lovett had 10 points.

    Quinerly had 10 points as the Mountaineers hit 10 of 15 shots to race to a 28-9 lead after one quarter. West Virginia was 4 of 6 on 3-pointers while the Sun Devils were 4 of 14 overall.

    EAST LANSING, Mich. (AP) ā€” Theryn Hallock scored 17 points, Julia Ayrault added 16 and No. 21 Michigan State beat Penn State for its fourth straight victory.

    Michigan State (16-3, 6-2 Big Ten Conference) has also won four straight in the series and eight of the last nine.

    Jocelyn Tate scored 12 of Michigan Stateā€™s opening 27 points in building a 12-point lead. The Spartans extended their lead to 41-24 at the break after scoring 18 points off 18 Penn State turnovers.

    Michigan Stateā€™s lead reached 31 points midway through the third quarter following a 19-3 run, with eight points from Ayrault.

    Hallock, Ayrault and Tate each made three of Michigan Stateā€™s 13 3-pointers to counter Moriah Murrayā€™s career-high-tying eight 3-pointers for Penn State.

    Tate finished with 15 points, five assists and three blocks for Michigan State. Grace VanSlooten added 10 points.

    No. 24 MICHIGAN 70, No. 23 MINNESOTA 65

    MINNEAPOLIS (AP) ā€” Freshman Syla Swords scored 23 points, eight in the fourth quarter, and No. 24 Michigan edged No. 23 Minnesota.

    Olivia Olson, a freshman from New Hope, Minnesota, added 19 points for the Wolverines (14-4, 5-3 Big Ten Conference), including a jumper to open the fourth quarter that gave them a 55-53 lead. Swords followed that with a 3-pointer and the defense held the Golden Gophers (17-3, 5-3) to 4-of-15 shooting.

    Mila Holloway, another freshman, scored 12 points for Michigan, which has won 9 of 11 in the series to close within 36-34 after 70 games. The Wolverines won their fourth straight with their first win in six games against ranked teams.

    Amaya Battle scored 25 points for the Golden Gophers, who were 11-0 at home. It was the first top 25 matchup at Minnesota in five seasons. Annika Stewart added 16 points off the bench and Grace Grocholski had 12.

    Stewart had 13 points on 4-of-4 shooting and Battle 12 on 5-of-6 shooting as the Golden Gophers scored the last nine points of the second quarter to lead 37-33 at the half. Stewart knocked down a 3-pointer and Battle contributed a three-point play. The Wolverines missed their last nine shots of the second quarter to finish the stanza at 2 of 16.

    In 1991, when Representative Elton Gallegly, a California Republican, sponsored a bill trying to restrict the Fourteenth Amendment, he referred to Schuck and Smithā€™s work. California, Gallegly said, had been enriched by the arrival of Latinos, Asians and others, but the rise in illegal immigration was a burden to law enforcement, medical facilities, schools and social welfare agencies. When considered together with the expanded welfare state, he said, the effects of birthright citizenship laws were ā€œclearly harmful.ā€ He also noted that it was harder to deport unauthorized parents if they had children who were citizens.

    Galleglyā€™s bill died in committee, but support for the idea of restricting the application of the 14th Amendment grew. The epithet ā€œanchor babiesā€ gained traction in the early 2000s as a way to suggest that undocumented parents had children in the United States primarily to ward off deportation. For three years beginning in 2013, Texas stopped issuing birth certificates for some children of unauthorized migrants.

    Unlike Schuck and Smith, most legal scholars believe that changing birthright citizenship requires ratifying a new constitutional amendment, a process that takes years and is unlikely to succeed. So many proponents of restriction would like to see the Supreme Court issue a decision that defines the amendment more narrowly. If Trump issues an executive order, it could force that court battle.

    In North and South America, where territorial birthright citizenship is standard, the policy has been a tool for strengthening statehood, said Maarten Vink, the co-director of the Global Citizenship Observatory, since it breaks immigrantsā€™ links with their home nations and fosters deeper ties to their adopted country.

    But the identities of these nations are now well-established, and as the global population turns more transient, more countries have tossed out jus soli. Since 1980, England, Australia, Ireland and New Zealand have all redefined citizenship so that it falls primarily along blood lines. In each case, new laws followed a rise in immigration from less developed regions of the world.
