    CO in fatal inmate beating from North Country; AG’s Office recuses itself from probe


    ALBANY, New York (WWNY) – 7 News has confirmed one of the correctional officers implicated in the fatal beating of an inmate is from the North Country. This comes as state Attorney General Letitia James announced her office has stepped away from the investigation.

    On the evening of December 9, body camera footage caught COs assaulting inmate Robert Brooks at Marcy Correctional Facility near Utica. Brooks died hours later at a Utica Hospital.

    We reported earlier that one of those correctional officers was identified as 44-year-old David Kingsley. 7 News has confirmed that he lives in the village of Adams.

    He and 13 other prison staff have been implicated in the fatal beating, which will now be investigated not by the state Attorney General’s Office, but by the Onondaga County District Attorney’s Office.

    On Thursday, AG Letitia James announced her office recused itself from the probe.

    “Four of the correction officers under investigation in the Robert Brooks matter are currently defendants in other matters and are being represented by lawyers in the Office of the Attorney General,” said James in a prepared statement. “While we are confident in the firewalls set up between the Division of State Counsel and the Office of Special Investigation, even the possibility or mere appearance of a conflict could tie up a potential prosecution in lengthy legal challenges or get a potential prosecution outright dismissed. And I will not allow justice to be delayed or denied because of a conflict.”

    The AG said Onondaga County District Attorney William J. Fitzpatrick has been named the special prosecutor.

    “District Attorney Fitzpatrick has served Onondaga County for over 30 years. His office is well-resourced to handle this complex and large investigation, and I thank him for taking on this case,” James said.

    “Earlier today, after much consideration, research, and review, my office decided to recuse itself from the investigation of the correction officers involved in the events preceding the death of Mr. Robert Brooks at Marcy Correctional Facility in Oneida County.

    “This decision is not one that was made lightly, but we believe this is the best course of action to protect the integrity of the investigation, and to ensure accountability and justice for Mr. Brooks, his family, friends, loved ones, and for all New Yorkers.

    “My office’s Division of State Counsel, by law, represents state agencies in legal matters, including the Department of Corrections and correction officers.

    “My Office of Special Investigation investigates matters where an officer of the law may have caused the death of a civilian.

    “As part of our Office of Special Investigation cases, we do internal conflicts checks.

    “After obtaining video and identifying the officers involved in the incident, we conducted this standard check.

    “Four of the correction officers under investigation in the Robert Brooks matter are currently defendants in other matters and are being represented by lawyers in the Office of the Attorney General.

    “While we are confident in the firewalls set up between the Division of State Counsel and the Office of Special Investigation, even the possibility or mere appearance of a conflict could tie up a potential prosecution in lengthy legal challenges or get a potential prosecution outright dismissed.

    “And I will not allow justice to be delayed or denied because of a conflict.

    “Earlier today, we filed papers in Onondaga County Supreme Court under County Law Section 701 to appoint Onondaga County District Attorney William J. Fitzpatrick as a special prosecutor in this matter.

    “When a prosecutor is unable to take a case, County Law Section 701 allows for the appointment of a district attorney in the same judicial department.

    “District Attorney Fitzpatrick has served Onondaga County for over 30 years. His office is well resourced to handle this complex and large investigation, and I thank him for taking on this case.

    “Additionally, my office’s Division of State Counsel will not represent the Department of Corrections and/or its officers in this investigation.

    “Again, this decision was made with the utmost respect for the integrity of this investigation, and we will ensure that there will not be any delays.

    “My Office of Special Investigation will hand over all records to the District Attorney’s office immediately.

    “My office has spoken with representatives of Mr. Brooks’ family to explain this decision. And I want to take this opportunity again to express my sincerest condolences to them during this unimaginable, difficult time.

    “It is critically important that justice is served. This decision ensures that it will be.”

    Former President Jimmy Carter served just a single term in the White House, but it proved to be an impactful one for the federal courts, which saw the appointment of more than 260 federal judges across the country, including some who would go on to wield considerable influence in the nation’s top courts. 

    His appointments were barrier-breaking and diverse, helping reshape the federal bench and paving the way for women and minorities to serve on the Supreme Court. 

    Here are just some of the ways Carter helped reshape the federal judiciary during his four years in office.

    Diversifying the bench  

    Carter appointed a total of 262 federal judges during his four years in the White House, more than any single-term president in U.S. history. And despite never getting to appoint a Supreme Court nominee, Carter’s judicial appointments were history-making in their own right. That’s because he appointed a record number of minority and female jurists during his presidency, announcing 57 minority judges and 41 female jurists during his four years in office.

    This was aided in part by Carter’s creation of the Circuit Court Nominating Commissions during his first year as president, which he tasked with identifying potential judicial candidates as part of an overarching effort to make the U.S. courts look more like the populations they represented.

    These judges helped diversify the federal judiciary. More broadly, they also helped shape the hundreds of court opinions handed down at the district and appellate court level.

    Supreme Court impact

    Speaking to NBC News’s Brian Williams in 2005, Carter revealed that he had planned to nominate a woman to serve on the Supreme Court if a vacancy had opened up during his presidency. 

    In fact, Carter even had a name in mind: Judge Shirley Hufstedler, who in 1968 was appointed by then-President Lyndon B. Johnson to the Ninth Circuit Court of Appeals. She was the first woman to serve as an appellate court judge. 

    “Had I had a vacancy,” he told Williams, Hufstedler was “the foremost candidate in my mind.”

    Carter did go on to choose Hufstedler for another role: the nation’s first secretary of education.

    “If I had had a Supreme Court appointment, she was the one in my mind that I had in store for the job,” Carter said. 

    It would instead be Carter’s successor, Ronald Reagan, who would go on to nominate the nation’s first female Supreme Court justice, Sandra Day O’Connor, in 1981.

    Though Carter did not directly appoint any judges to the Supreme Court as president, two of his appellate court nominees would go on to serve on the nation’s highest court: Stephen Breyer, who he tapped for the U.S. Appeals Court, and Ruth Bader Ginsburg, who Carter appointed to the U.S. Court of Appeals for the D.C. Circuit.

    Both were tapped by former President Bill Clinton to serve on the Supreme Court in the early 1990s and both were subsequently replaced by women jurists. Breyer retired in 2022, replaced by President Biden’s sole nominee to the court, Justice Ketanji Brown Jackson. Ginsburg died in September 2020 and was replaced by Justice Amy Coney Barrett.

    CARTER EXPECTED TO LIE IN CAPITOL ROTUNDA

    Ginsburg was praised for her trailblazing work on gender discrimination. In nominating her to the Supreme Court in 1993, Clinton lauded Ginsburg for being “to the women’s movement what Thurgood Marshall was to the movement for the rights of African Americans.”

    In public speeches, Ginsburg often credited Carter for his work in reshaping the judiciary.

    “Women weren’t on the bench in numbers, on the federal bench, until Jimmy Carter became president,” Ginsburg said in a 2015 speech at the American Constitution Society.

    Carter “deserves tremendous credit for that,” she said.

    The singer died in hospital at Gin Gin near Bundaberg in Queensland on the evening of New Year’s Day, according to the ABC.

    Chad, known fondly by his well-known nickname ‘The Sheik of Scrubby Creek’, was one of the best-known pioneers in Australian country music.

    His son Chad Junior confirmed his father’s passing and tributes quickly flooded in for the nationally beloved music icon.

    Country singer Evelyn Bury, who was a good friend of Chad’s, described the singer as a ‘beautiful larrikin’ in a heartfelt tribute.

    ‘There’ll never be another Chad,’ she added.

    Chad was born in 1933 and raised in the South Burnett town of Wondai by his grandparents. 

    He worked cutting timber and sugar before he was discovered through Australia’s Amateur Hour radio program and launched his music career.

    ‘I went into the air force in ’52 and mates heard me singing and they dared me to go on Amateur Hour and it snowballed from there,’ Chad previously told the ABC. 

    He started recording with Regal Zonophone and in 1958, he released his debut album The Sheik of Scrubby Creek, the title of which refers to his well-known nickname.

    Chad had a hugely successful country music career spanning more than 70 years and has played all over Australia at almost every venue from pubs to the Sydney Opera House.

    He was also a regular on Reg Lindsay’s Country and Western Hour and was beloved for his signature sense of humour.

    He is best-known for his comedic country tracks including I’m My Own Grandpa, The Shotgun Wedding, Double Decker Blowflies and There’s Life In The Old Dog Yet.

    As well as his hugely successful career, Chad’s distinctive teeth were also believed to have inspired Barry Humphries iconic character Les Patterson.

    Chad boasts platinum and gold album sales and was inducted into the Tamworth Hands of Fame in 1979. 

    In 2004, he received a Medal of the Order of Australia and he was also recognised with a lifetime achievement award at the 2010 Country Music Association of Australia Awards.

    Last year, there was a push to induct Chad into the Australian ARIA Hall of Fame led by Anna Rose, who wrote a biography about his life and career.

    ‘I think it’s an absolute tragedy that he’s got to the age of 90 and has not been put into the hall of fame. So many others have,’ Anna told The Senior

    ‘And I’m wondering how many of those have a 70-year career that’s been exceptional. And he’s known not just all over Australia but all over the world.’ 

    In his personal life, Chad married fellow singer Pam Mitchell and they went on to welcome three children – Allan, Chad Jr and Janelle.

    After their split, Chad went on to re-marry Joan Morgan when he was in his 50s and they were together for more than 30 years until her death in 2017.

    Larrikin country music singer Chad Morgan — fondly known as the “Sheik of Scrubby Creek” — has died aged 91.

    The Australian country music icon died in hospital at Gin Gin near Bundaberg in Queensland on the evening of January 1, 2025.

    Son Chad Junior confirmed his father’s death to the ABC as tributes flowed for the man who provided joy, laughter, and entertainment to generations of fans.

    Fellow country singer and good friend Evelyn Bury described Morgan as a “beautiful larrikin”.

    “There’ll never be another Chad,” she said.

    Country music star Troy Cassar-Daley posted to social media that Morgan was one of the funniest comedic minds he had ever witnessed on stage.

    “He was always such an individual, that’s what endeared him to so many in our industry,” he wrote.

    One of Australian country music’s most recognisable pioneers, Morgan was born in the South Burnett town of Wondai in 1933.

    Raised by his grandparents, Morgan worked cutting timber and sugar around Childers before he was discovered through Australia’s Amateur Hour radio program and started recording with Regal Zonophone.

    Wearing his upturned hat with a safety pin and brandishing a signature smile, Morgan recorded and performed music for more than 70 years. 

    He released his first album in 1952.

    “I went into the air force in ’52 and mates heard me singing and they dared me to go on Amateur Hour and it snowballed from there,” he said of his career in an ABC interview at Tamworth in 2016.

    Celebrated career

    Morgan has platinum and gold album sales and has played all over Australia in all of manner of places, from tents to trucks, clubs, pubs and festivals to the Sydney Opera House.

    He was the king of the country comedy genre with his songs The Sheik of Scrubby Creek, I’m My Own Grandpa, The Shotgun Wedding, Double Decker Blowflies and There’s Life In The Old Dog Yet.

    Morgan was inducted into the Tamworth Hands of Fame in 1979, the Roll of Renown in 1987 and received a Medal of the Order of Australia (OAM) in 2004. 

    He was recognised with a lifetime achievement award at the 2010 Country Music Association of Australia Awards.

    One of Morgan’s final interviews was recorded at the opening of a permanent exhibition in his honour at Childers in August.

    ‘Larger than life’

    Photographer John Elliot grew up in Blackall, outback Queensland, and remembers his first Chad Morgan show.

    “He was larger than life — terrified the hell out of me when I was four or five,” he said.

    “He just didn’t seem real, he was so different from all the other performers.”

    Mr Elliot described Morgan as the original rockstar, the original punk.

    Throughout Mr Elliot’s career photographing country music artists across Australia, he and Morgan built a relationship through the lens.

    Mr Elliot said driving was Morgan’s choice of transport while touring the country throughout his career.

    “One of our mutual friends said Chad was doing this long before rock stars hired Taragos to go to shows,” he said.

    “They drove their cars through every dirty road across Australia. I think I talked him into flying to Winton [the last time], but driving was his preferred form of transport.

    “Chad Morgan may be good, but I don’t think they’ll be making another one.”

    Australian country music singer Chad Morgan, known as the “Sheik of Scrubby Creek” after one of his most famous songs, has died aged 91.

    Known for his humorous country songs and toothy smile – which inspired Barry Humphries’ design for his character Sir Les Patterson – Morgan’s music career spanned more than 70 years, releasing his first album in 1952. He was dubbed the “clown prince of comedy” by country music legend Slim Dusty.

    Morgan died in a hospital at Gin Gin in Queensland on Wednesday, his son Chad Junior confirmed to the ABC.

    Country music star Troy Cassar-Daley remembered Morgan as “so funny and whip smart”.

    “He always surprised me when he hit the stage at how many generations loved him,” he wrote on Instagram. “Rest easy old mate, the show is over and the curtains are closed now.”

    Morgan was born in Wondai, Queensland in 1933 and was working in the Royal Australian air force when he was went on talent quest radio program Australia’s Amateur Hour, having been dared to enter by his friends in his unit.

    “Never dare me to do anything,” he told the State Library of Queensland in 2018. “I got into the semi-finals and I had to go to Sydney for that … when I did the show down there, someone from the record company heard me and they offered to record me … all my life that was my one ambition, was to record for [country label] Regal Zonophone.”

    Morgan’s best known songs included The Sheik of Scrubby Creek, I’m My Own Grandpa, The Shotgun Wedding, Double Decker Blowflies and There’s Life In The Old Dog Yet. He also contributed one verse to the Gordon Parsons song A Pub with No Beer.

    In 2009, he wrote a song about his Aboriginal heritage, The Ballad of Bill and Eva, named for his grandparents and recorded with his granddaughter Caitlin.

    Morgan toured until 2024, announcing his retirement at the age of 91 in April. Over his long career he performed everywhere around Australia from tiny country festivals to the Sydney Opera House, where he played four encores.

    After false rumours of his death began to spread in 2008, Morgan’s life inspired a documentary film titled I’m Not Dead Yet.

    He was inducted into the Tamworth Hands of Fame in 1979 and the Roll of Renown in 1987. He received a medal of the Order of Australia in 2004, a lifetime achievement award at the 2010 Country Music Association of Australia awards, and another at the 2018 Queensland Music awards.

    Last night, country music superstar Jason Aldean made a surprise appearance at a local Nashville music venue, joining up-and-coming musician Emily Davis on stage for an unforgettable performance.

    During his Wild Horses Festival headlining set at Petco Park in San Diego, the “I Had Some Help” musician revealed the two artists he couldn’t get enough of in 2024.

    Addressing the crowd, Malone, 29, first clarified he’s an Apple Music user and usually doesn’t pay much attention to those things. This year, however, he decided to share that his top two artists were “George Strait” and “Zach Top.”

    After declaring his 2024 favorites, Malone introduced Top, 27, to the stage, and together they covered Vince Gill’s “Don’t Let Our Love Start Slippin’ Away.”

    Meanwhile, Malone’s set featured a blend of country songs from his most recent album F-1 Trillion and older hits like “Circles,” “I Fall Apart,” “Rockstar” and “Sunflower.”

    Malone’s headlining performance comes after his appearance during Beyoncé‘s epic Christmas Day halftime show at the Texans-Ravens game at NRG Stadium in Houston. Together, they performed their Cowboy Carter collab “LEVII’S JEANS.”

    The “Better Now” singer expressed his appreciation for the moment in a message shared on X (formerly Twitter) on Saturday, Dec. 28.

    In November, he announced he’ll embark on The Big Ass Stadium Tour throughout North America in summer 2025 with Jelly Roll, whom he collaborated with on “Losers.”

    The massive tour kicks off April 29 in Salt Lake City and makes stops in cities including Las Vegas, Dallas, Atlanta, Detroit, Chicago, New York, Miami, Orlando, Denver, Seattle and more before wrapping July 1 in San Francisco.

    F-1 Trillion was released in August, and the project reached No. 1 on the Billboard 200 albums chart. Days beforehand, the “Chemical” performer marked a major milestone in his country music career when he made his Grand Ole Opry debut.

    “He has a country heart and he is someone who immersed himself in the Nashville way,” Brad Paisley, who invited Malone to perform at the Opry, led off the performance by noting. “But you aren’t a country singer until you’ve played this.”
