    The family of an OpenAI whistleblower have called for his death to be reinvestigated after it was ruled to be a suicide.

    Suchir Balaji, 26, a former OpenAI engineer who helped train the artificial intelligence systems behind ChatGPT and later said he believed those practices violated copyright law was found dead just days before he was called to be a witness in a case, his family said.

    Balaji was found dead in his San Francisco apartment on November 26 in what police said “appeared to be a suicide. No evidence of foul play was found during the initial investigation.”

    The city’s chief medical examiner’s office confirmed the manner of death to be suicide but a congressman has now backed calls for an FBI investigation into the death.

    His parents Poornima Ramarao and Balaji Ramamurthy said they are still seeking answers, describing their son as a “happy, smart and brave young man” who loved to hike and recently returned from a trip with friends.

    In a new interview with KTVU, Ramarao insisted there were things out of place in his “ransacked” apartment where his body was found four days before he was due to be called as a witness to the OpenAI case.

    “The pin drive is missing. His computer was messed up. His desktop was left on for three days. It’s messed up”, she added.

    They claim he was called as a witness for a copyright case against OpenAI four days before his death.

    “You can see how happy he is. We want the world to see his happy mood just before his death,” said Ramarao.

    She added that there was some “sign of struggle in the bathroom and looks like someone hit him in the bathroom based on blood spots.”

    Ramarao says the family will conduct an independent autopsy after attention was drawn to the case by Tesla billionaire Elon Musk who posted an interview with Ms Ramarao labelling the case “extremely concerning”.

    On December 29, Musk posted: “This doesn’t seem like a suicide”.

    Congressman Ro Khanna backed the family’s calls for an investigation after being texted live on air by Conservative firebrand Tucker Carlson as he interviewed Balaji’s family.

    Khanna said: “My heart breaks for Suchir Balaji’s family and his mother, Poornima Ramarao, who I spoke to yesterday. It is a tragic loss. I trust that the appropriate federal law enforcement agencies will conduct an investigation.

    “Let them investigate and bring it out, rather than speculating about something. We want the truth to come out and a report from the authorities as to what could be the reason for his death,” said Ms Ramarao.

    Suchir first raised his concerns around OpenAI with The New York Times, which reported them in an October profile of Balaji.

    He later told The Associated Press he would “try to testify” in the strongest copyright infringement cases and considered a lawsuit brought by The New York Times last year to be the “most serious.” Times lawyers named him in a Nov. 18 court filing as someone who might have “unique and relevant documents” supporting allegations of OpenAI’s willful copyright infringement.

    He said gradually grew more disillusioned with OpenAI, especially after the internal turmoil that led its board of directors to fire and then rehire CEO Sam Altman last year.

  • Suicide ruling in Ellen Greenberg’s death should be changed, says doctor who made initial ruling


    The pathologist who ruled Ellen Greenberg’s 2011 death by 20 stab wounds a homicide then switched it to suicide, said he now believes her death “should be designated as something other than suicide.”

    That admission from Marlon Osbourne — the former assistant medical examiner with the Philadelphia Medical Examiner’s Office who conducted Greenberg’s autopsy — came in a sworn statement he signed Friday as part of a settlement agreement in one of two civil lawsuits Greenberg’s parents, Joshua and Sandra, are currently fighting in court.

    “ … [B]ased on my consideration of the new information brought to my attention after leaving my position as Medical Examiner for the City of Philadelphia, along with my original autopsy findings and information considered while I was actively involved in Ellen’s case, it is my professional opinion Ellen’s manner of death should be designated as something other than suicide,” Osbourne said in his sworn statement.

    The Greenbergs’ attorney, Joseph Podraza Jr., said his clients didn’t request monetary damages from Osbourne, who now works for a pathology practice in Florida. What was “of greater value to the Greenbergs,” Podraza said, was Osbourne’s “acknowledgment that the manner of death should not be suicide.”

    “It’s a tremendous statement by Dr. Osbourne, as far as I’m concerned, and a courageous one,” Podraza said in an interview Sunday. “The only thing unfortunate about it is how late in time it came. It should have come earlier, but we are grateful he has done the right thing.”

    Filed in 2022, the lawsuit alleges the investigation into Ellen Greenberg’s death was “deeply botched” and subsequently resulted in a “cover-up” by Philadelphia authorities. Podraza filed the suit, which seeks monetary damages for intentional infliction of emotional distress, against several city employees who were involved in the investigation.

    ‘180 degrees’

    At a lengthy hearing in December, attorneys from the Philadelphia Law Department, which represents three of the defendants, and outside attorneys for two other defendants, including Osbourne, argued for the case to be dismissed during a summary judgment hearing before Common Pleas Court Judge Michael Erdos.

    Erdos immediately granted summary judgment for one defendant but withheld his ruling on the other four, including Osbourne and the three defendants represented by city attorneys — former Chief Medical Examiner Sam Gulino; retired Homicide Sgt. Tim Cooney; and Homicide Detective John McNamee.

    On Friday, Erdos rendered his verdict, granting summary judgment for Cooney, but allowing the cases against Osbourne, Gulino, and McNamee to move forward.

    Now that Osbourne has settled, Gulino and McNamee are the only defendants left. On Friday, a spokesperson for the city law department said attorneys were “still assessing the order and our next steps” and that the department would not comment as litigation remains ongoing.

    Podraza said it’s his understanding the city intends to defend the case at trial. Jury selection is slated for Monday with opening arguments set for Tuesday.

    “Finally, the issuing pathologist has changed his position 180 degrees. It’s consistent with what the Greenbergs have been contending all along, and somehow the city does not find it within its heart to do the right thing but instead just continues to inflict great emotional distress upon them?” Podraza said. “It’s sad and it’s sick.”

    Greenberg’s death

    Greenberg, 27, a first-grade teacher at Juniata Park Academy, was found by her fiance, Samuel Goldberg, in the kitchen of their Venice Lofts apartment in Manayunk with a 10-inch knife lodged into her chest on Jan. 26, 2011.

    Investigators on the scene treated her death as a suicide because Goldberg told them the apartment door was locked from the inside and he had to break it down to get in. There were no signs of an intruder and Greenberg had no defensive wounds, police have said.

    But the next morning at her autopsy, Osbourne discovered a total of 20 stab wounds to Greenberg’s body, including 10 to the back of her neck, along with 11 bruises in various stages of healing, and ruled her death a homicide.

    Police publicly disputed the findings and Osbourne later changed his ruling to suicide. The Greenbergs subsequently retained numerous independent forensic experts who have questioned authorities’ findings, as first detailed in a March 2019 Inquirer report.

    In the 2022 suit, Podraza and the Greenbergs allege police “embarrassingly botched” their investigation at the scene on the night of Ellen Greenberg’s death and that a “contemptible conspiracy” has continued for more than 14 years since to cover it up.

    The suit alleges that investigators took Goldberg at his word that his fiancee’s death was a suicide and they did not call the Crime Scene Unit or secure the scene. The following day, police approved a cleaning service to sanitize the apartment, a service that was paid for by members of Goldberg’s family, and they allowed Goldberg’s relatives to enter the apartment and remove items from it, including a cell phone and two laptop computers belonging to Greenberg, which police later requested back as evidence, according to the suit.

    When Osbourne ruled the death a homicide, homicide investigators had to investigate a scene that was already cleaned and compromised and they “had to convince the MEO (or enlist their help) to change Ellen’s manner of death to suicide to avoid exposing their botched investigation,” the suit contends.

    Reasons for change

    In his sworn statement Friday, Osbourne said he changed his initial ruling from homicide to suicide based on evaluation of the case file, additional information provided to him by police, and a consultation he claims he obtained from an outside neuropathologist (though no record of that consultation exists and Podraza still contends it did not happen).

    Osbourne’s statement said he’s since become aware of information that draws his suicide ruling into question, including whether someone witnessed Goldberg breaking the door down, whether it was broken down at all, whether Greenberg’s body was moved, and whether two cuts to her spinal column could have been administered after she died.

    While he believes the ruling should be changed, Osbourne said in his statement that “It is my understanding that I am no longer empowered to amend Ellen’s death certificate myself because I no longer maintain a Pennsylvania medical license and am no longer employed by the Philadelphia Medical Examiner’s Office.”

    Podraza contends, as he has all along, that Osbourne does have the power to change his ruling under Pennsylvania code.

    “But we didn’t believe it worth a fight because the bottom line is that’s a skirmish, we wanted the war, and the war is him conceding this should not be a suicide,” he said.

    Requests for comment to Osbourne’s lawyer, Marc B. Bailkin, were not returned.

    The first civil suit

    Podraza believes the city Medical Examiner’s Office should change the death certificate in light of Osbourne’s statement, but if that doesn’t happen, the Greenbergs’ first civil lawsuit, which is up for a hearing before the Supreme Court of Pennsylvania later this year, could pave the way.

    Filed in 2019 against Osbourne and the Philadelphia Medical Examiner’s Office, that suit — which is being defended by the city’s law department — seeks to have the manner of Ellen Greenberg’s death changed from suicide back to homicide or undetermined.

    Podraza said he believes Osbourne’s new statement will “help us tremendously” in both ongoing lawsuits.

    “The predominant reason is that it gives credence from the other side that Ellen’s death is not a suicide,” he said. “The refusal to date of the defendants to not follow Osbourne’s action of saying this is not a suicide really demonstrates their lack of regard for the Greenbergs or any other citizens.”

    Despite authorities ruling that Greenberg’s death was a suicide after saying only her DNA was found on the knife and her clothing, her parents have maintained the belief that their daughter was murdered.

    Now, Marlon Osbourne, formerly of the Philadelphia Medical Examiner’s Office, says in a sworn statement that he should not have ruled Greenberg’s death a suicide, according to reports from the Philadelphia Inquirer and PennLive.

    “[B]ased on my consideration of the new information brought to my attention after leaving my position as Medical Examiner for the City of Philadelphia, along with my original autopsy findings and information considered while I was actively involved in Ellen’s case,” Osbourne wrote in the reported statement, which is part of a settlement agreement in a lawsuit involving Greenberg’s parents, “it is my professional opinion Ellen’s manner of death should be designated as something other than suicide.”

    Greenberg was found dead in 2011 by her fiancé, Sam Goldberg, after he returned to their home in Philadelphia. 

    PEOPLE previously reported that Goldberg told police he was unable to get into the apartment because the swing bar lock was in use. He eventually forced his way into the residence, where he discovered Greenberg dead with a 10-inch knife in her chest.

    That is what the West has been learning watching Kim Jong Un’s army in action after Russian President Vladimir Putin called on the North Korean leader to supply fighters for his war on Ukraine.

    Pyongyang deployed 11,000 men to Kursk in November disguised as Russian soldiers and carrying fake IDs. These troops are largely special operations forces, meaning they are more ardent in their beliefs and better trained than other units.

    Russia has been pushing the North Koreans headlong into bloody assaults. The costs are high, but Kim’s army is learning an important lesson in return: how to fight a modern war.

    This war is North Korea’s largest military deployment to a foreign conflict in its almost 80-year history. To determine what the West is learning from this moment, Business Insider spoke to experts who have been closely following North Korea’s performance, examined publicly released intelligence, and reviewed Ukrainians’ observations.

    Ukrainian and South Korean intelligence services have said that many of the troops that deployed to Russia are some of Pyongyang’s best, drawn from the 11th Corps, also known as the Storm Corps. The unit is trained in infiltration, infrastructure sabotage, and assassinations.

    Ukraine’s top general, Oleksandr Syrsky, has said the North Korean troops are “highly motivated, well-trained,” and “brave.” And the Pentagon said this month that “these are relatively well-disciplined, competent forces” that are by all accounts “capable.”

    Some Ukrainian soldiers have relayed their experiences to Western media, describing the troops as fast and nimble, good shots, and seemingly fearless as they rush into battle despite heavy losses. North Korean soldiers have also been found carrying diaries with written dedications to Kim and their country.

    “They, as individuals, are more skilled as soldiers, more disciplined as soldiers, more willing to fight as soldiers than some sources had presumed when they were first being sent there,” said Joseph Bermudez, an expert on North Korea’s armed forces at the Center for International and Strategic Studies.

    North Korea has a culture driven by a martial philosophy that celebrates hard military power, and it maintains one of the world’s largest standing armies with around 1.2 million soldiers.

    The country’s direct entry into the war has complicated the situation for the Ukrainians, particularly in Russia’s Kursk where Ukraine is struggling to hold captured ground. Ukraine has lost roughly half of the territory it once held inside Russia, and the relentless human wave attacks and brutal assaults have worn down Ukraine’s already strained defenses, depriving Kyiv’s forces of time to rest and brace for further attacks.

    The South Korean Joint Chiefs of Staff said last month that North Korea may be planning to deploy additional forces and military equipment to Russia.

    Pyongyang has denied sending troops to Russia, and Kyiv has said Russian and North Korean forces attempt to remove dead North Korean soldiers from the battlefield or even burn the faces of dead North Koreans to make them difficult to identify.

    Russia has been sending the North Korean forces into very high-casualty front-line assaults. Biden’s White House said late last month that “it is clear that Russian and North Korean military leaders are treating these troops as expendable and ordering them on hopeless assaults against Ukrainian defenses.”

    A White House spokesperson previously described the North Koreans as “highly indoctrinated, pushing attacks even when it is clear that those attacks are futile.”

    The Trump administration did not respond to a request for comment on its assessment of North Korean forces fighting in Russia.

    Ukraine’s Special Operation Forces said Friday the North Koreans fighting for Russia had not been seen in the Kursk area for around three weeks and had likely been withdrawn due to the heavy combat losses. BI was unable to independently confirm these details.

    On the front lines, Ukrainian soldiers have said that the North Koreans are a capable fighting force that is adept at neutralizing drones. The soldiers are ruthlessly tough and determined, relentlessly pushing forward in “human wave” assaults, using fellow soldiers as bait, and casting aside armor for faster infantry movements. And they refuse to surrender, often opting to kill themselves with a grenade or bullet rather than be captured.

    This is a defining element of the North Korean special operations training: soldiers are trained to follow orders aggressively, even if they suspect it will cost them their lives. If they disobey orders or fail without sacrifice, their families could suffer the consequences, Bermudez said.

    North Korea is learning lessons in modern warfare

    North Korean forces have suffered heavy losses fighting for Russia, per Western intelligence. Despite training with Moscow on infantry tactics, flying drones, artillery, and trench-clearing operations, the troops are still new to this war.

    The soldiers “have been observed engaging in light infantry operations of a Second World War vintage — one man draws out enemy fire (in this case, drones) to locate a target, and others attempt to neutralize said target,” said Michael Madden, a Stimson Center Korea expert. They have not prepared for a mechanized battlefield like Ukraine’s, filled with armored vehicles and tanks.

    “They’ve been trained to fight a war on the Korean Peninsula,” Bermudez said, and while North Korea has watched various armed conflicts closely over the decades, its forces are now getting a real taste for it on a battlefield and in an environment they haven’t been prepping for.

    In the short term, that could have devastating consequences for the North Korean forces fighting for the Russians. The Institute for the Study of War think tank assesses that the entire 11,000-man contingent of North Korean forces could be killed or wounded in action by April if the current casualty rate continues. The latest estimates put losses around 4,000.

    North Korea may consider these sacrifices worth it — if not for the Russian cause, then for what it learns in return.

    “It is a dark version of the concept of ‘you learn by doing,’” Madden said, noting that it’s still early. “We will need further incidents and engagements to make more sound observations as to whether they are adjusting their tactics given the state of play in Russia and Ukraine.”

    But there is no doubt they’re learning, acquiring knowledge critical for future conflicts that will make North Korea a more challenging combat force in East Asia. They’re seeing the Ukrainian use of US- and Western-provided weapons systems, such as HIMARS and Abrams, for example, and how the Russians have adapted to them.

    “They’re bringing these lessons home in the hardest way possible: by bleeding for them,” Bermudez said.
