Harvey Weinstein’s retrial on rape charges in New York is set for April 15
Harvey Weinstein, the disgraced Hollywood mogul whose sexual misconduct helped fuel the #MeToo movement, will face retrial in New York on rape charges on April 15, a judge announced Wednesday.
Weinstein, 72, was convicted in 2020 in New York of the third-degree rape of one woman and a first-degree criminal sex act against another woman and sentenced to 23 years in prison. That conviction was overturned last April after a state appellate court, in a 4-3 decision, determined that the trial judge had erred by allowing women to testify about allegations that were not part of the case.
In September, a New York City grand jury indicted Weinstein on new charges.
Judge Curtis Farber said Wednesday that Weinstein’s retrial will include a new allegation involving a woman who wasn’t in the original case. The woman alleges he forced oral sex on her at a Manhattan hotel in 2006.
Weinstein is being held at the Rikers Island jail complex. He arrived in the Manhattan courtroom Wednesday in a wheelchair amid a litany of health issues. NBC News was first to report last year that he has chronic myeloid leukemia.
During the court hearing, Weinstein pushed for an earlier trial date, citing his health.
“I won’t be there for April,” he said. “I can’t wait for tomorrow. I can’t hold on anymore. I am holding on because I want justice … I want this to be over with.”
Farber said he has another trial scheduled but would do his best to accommodate a date a week earlier if all parties agree. The judge also denied Weinstein’s attorney’s motion to dismiss the new indictment against him.
A spokesperson for Weinstein said in a statement after the hearing that “Judge Farber demonstrated exceptional responsiveness, and we deeply appreciate his thoughtful consideration of Harvey’s condition and circumstances. We remain confident in a swift and efficient trial process and firmly believe that Harvey will be fully exonerated.”
In addition to the New York case, Weinstein was found guilty of one count of rape and two counts of sexual assault in 2022 in Los Angeles and sentenced to 16 years. Weinstein’s legal team is appealing that conviction.
In all, more than 80 women have accused Weinstein of sexual assault or harassment. He has repeatedly denied the claims, insisting the encounters in question were consensual.
The charges against Weinstein were first reported in 2017 by The New York Times and The New Yorker. The articles inspired a wider reckoning in the entertainment and other high-profile industries.

Harvey Weinstein begged the court to push his trial date forward as he battles cancer.
Judge Curtis J. Farber set Weinstein’s rape retrial for April 15 during Wednesday’s hearing. However, the disgraced entertainment mogul claimed he would not be here in April.
“I’m asking and begging you to switch,” Weinstein told the judge in a rare direct address to the court. “I can’t hold on anymore. I’m holding on because I want justice for myself.”
Weinstein told Judge Farber that he was given the “wrong pills” earlier Wednesday morning but “caught” the mistake at the “right moment.”

“I am begging for you to move your date, so we can proceed with trial as quickly as possible, so I can get out of this hellhole,” he claimed. “There are so many people suffering in Rikers island. They don’t have the same mouthpiece. It’s a medieval situation. This is something that has to be stopped.”
Farber told Weinstein and his lawyers he was trying to resolve and move the trial up, but as of now, April 15 is the date that works.
“Judge Farber demonstrated exceptional responsiveness, and we deeply appreciate his thoughtful consideration of Harvey’s condition and circumstances,” Weinstein’s representative, Juda Engelmayer, told Fox News Digital in a statement. “He is literally batting for his life. We remain confident in a swift and efficient trial process and firmly believe that Harvey will be fully exonerated.”

Weinstein was rushed to Bellevue Hospital in December after receiving an “alarming blood test.” At the time, his rep confirmed the former film producer had been diagnosed with leukemia.
“Mr. Weinstein, who is suffering from a number of illnesses, including leukemia, has been deprived the medical attention that someone in his medical state deserves, prisoner or not. In many ways, this mistreatment constitutes cruel and unusual punishment,” Engelmayer previously told Fox News Digital in a statement.

Weinstein’s team has been adamant about his declining health in recent months, claiming he is “basically getting no treatment” for his various medical issues.
“All I can tell you is he is not getting the treatment he deserves,” Weinstein’s lawyer, Arthur Aidala, said after a court hearing in July. “He needs some relief. We are very confident of the outcome of this trial… he will get acquitted. There is a lot of light at the end of the tunnel for Mr. Weinstein.”

A New York appeals court overturned Weinstein’s 2020 rape conviction this past April, ordering a new trial in a stunning reversal of a landmark #MeToo case.
In a 4-3 decision, the court found that Weinstein’s trial judge allowed prosecutors to call women who said Weinstein had assaulted them to testify, even though their accusations did not specifically relate to the entertainment mogul’s charges.
Weinstein was sentenced to 23 years in prison after being convicted in February 2020 of forcing oral sex on TV and film production assistant Mimi Haley in 2006 and third-degree rape of hairstylist Jessica Mann in 2013. He was acquitted of first-degree rape and two counts of predatory sexual assault from actor Annabella Sciorra’s allegations of rape in the 1990s. Weinstein has denied ever engaging in non-consensual sex.

The upcoming Suits spinoff is already shaping up to be quite a drama-filled series — and the newest promo just name dropped a fan-favorite character.
Suits: LA is set to premiere on February 23, 2025 on NBC, and multiple reports already confirmed Gabriel Macht will reprise his Suits role as Harvey Specter. While he isn’t a main character on the new series, his presence is already being felt before the first episode airs on TV.
As folks can see in a new promo for Suits: LA, one snippet sees the main character Ted Black (Stephen Amell) sitting in the office of a former FBI agent named Kevin (Troy Winbush). When the camera pans to an old photo featuring Ted and Harvey, Kevin can’t help but compare the two lawyers.
“I remember this guy — Harvey,” Kevin says in a clip posted on Instagram. The only person I knew cockier than you.”
“That’s exactly why I liked him,” Ted wistfully replies back.
Given how not much else has been revealed about how Harvey will be folded into Suits: LA, fans of the original series were definitely excited about this moment online.
“The only exciting thing about this is Harvey’s comeback,” one person wrote in the comments. “Harvey Specter is back in the year of our lord 2025 YESSIR ,” another penned. “Harvey!!!!,” a different follower added.
As folks may know, Suits: LA will follow former New York prosecutor Ted, who has made a name for himself at a major law firm in Los Angeles. When Ted finds his place of work is in the middle of a crisis, he must step into a role that he never thought he’d hold.
Even though it’s unclear how exactly Ted and Harvey know each other, at least we’ll get to see the original Suits character come back in a new way.
