  • South Korea’s President Yoon Is Indicted


    South Korea’s impeached and arrested president, Yoon Suk Yeol, was formally indicted on Sunday on charges of leading an insurrection last month when he briefly imposed martial law, prosecutors said.

    Mr. Yoon’s indictment means that his trial is likely to start soon. It follows the indictments of a former defense minister and several military generals and police chiefs, all of whom face criminal charges of helping Mr. Yoon commit the same crime.

    He is the first president in South Korean history to face criminal charges while still in office.

    His downfall began when he unexpectedly declared martial law on Dec. 3, accusing the opposition-controlled National Assembly of “paralyzing” his government. The Assembly voted the measure down, forcing him to rescind the order after about six hours. But it has set off South Korea’s worst political crisis in decades.

    As people called for Mr. Yoon’s ouster, the Assembly impeached him on Dec. 14, suspending him from office. The country’s Constitutional Court is deliberating whether the parliamentary impeachment was legitimate and if he should be formally removed from office. Separately, criminal investigators detained Mr. Yoon on the insurrection charges on Jan. 15.

    From his jail cell, Mr. Yoon has vowed to fight to regain office.

    A majority of South Koreans approved of his impeachment and consider him guilty of insurrection, according to public opinion polls. But Mr. Yoon’s die-hard supporters have called his impeachment “fraud.” Some of them shocked the country when they vandalized a courthouse in Seoul after one of its judges approved a warrant to arrest him on Jan. 19. Nearly 60 people were arrested in connection with that unrest.

    Prosecutors said that Mr. Yoon committed insurrection during the short-lived imposition of martial law when, they said, he banned all political activities and ordered military commanders to break the Assembly’s doors down “with axes” or “by shooting, if necessary” and “drag out” lawmakers. They said Mr. Yoon sent the troops there to seize the Assembly and detain political leaders.

    The nation watched the live-streamed scenes of special forces troops armed with assault rifles storming the Assembly as lawmakers were gathering there to vote against martial law. But Mr. Yoon has rejected the charge of insurrection, saying that he never intended to neutralize the Parliament or arrest political leaders. The troops were there to “keep order,” he said.

    Mr. Yoon’s indictment, although not a surprise, came sooner than expected.

    State prosecutors have been investigating the former defense minister and generals. The country’s Corruption Investigation Office for High-ranking Officials took on the insurrection case against Mr. Yoon, but by law, only prosecutors can indict him.

    Mr. Yoon has refused to cooperate with the inquiry; he and his lawyers have insisted that the four-year-old office has no right to investigate him.

    On Thursday, the Corruption Investigation Office handed his case over to prosecutors. The two had earlier agreed that prosecutors had until early February to indict Mr. Yoon, and prosecutors had planned to further investigate Mr. Yoon’s actions.

    But on Friday, a judge in a Seoul court ruled that Mr. Yoon must be either be indicted sooner or released because the Corruption Investigation Office had already done an investigation.

  • Woman indicted in crash that killed Vikings rookie Khyree Jackson

    UPPER MARLBORO, Md. — A woman has been indicted in connection to a crash that killed Minnesota Vikings rookie cornerback Khyree Jackson in July 2024.

    In a press conference on Thursday afternoon, Prince George’s County (Maryland) state attorney Aisha Braveboy announced that a grand jury returned a 13-count indictment against Cori Clingman, including counts of vehicular manslaughter and driving while under the influence of alcohol. Braveboy said Clingman is currently in custody pending a bond review. She’s facing a maximum sentence of 30 years, according to Braveboy.

    Police said Jackson was riding in a vehicle on July 6, 2024, in Maryland with two former high school teammates when another vehicle attempting to change lanes struck them at a high rate of speed. The two teammates, Isaiah Hazel and Anthony Lytton, Jr., were also killed.

    “These were three young men who had gotten it right in life, who had amazing, bright futures ahead of them.” said Braveboy. “But on July 6, they were taken from all of us. … This was a horrific tragedy that should not have occurred.”

    The Vikings honored Jackson throughout the season in the locker room and on the field. His locker and No. 31 jersey went unused, while players wore a decal with his initials.

    Jackson, 24, was a fourth-round pick for the Vikings and was in the running to earn a starting spot after a strong showing at OTAs. He was a receiver in high school and helped lead his team to two state championships before attending Arizona Western Community College. He returned home after just a few weeks and eventually got so good at video games, that he considered pursuing a career as an NBA 2K League player.

    He was training for a tournament when he got a call from Fort Scott Community College about returning to the football field. He spent one season at Fort Scott before transferring to East Mississippi Community College for the 2020 season, which was eventually canceled due to COVID. He soon joined Alabama, where his first start came in the 2021 national championship game, and one year later, he transferred to Oregon to finish his collegiate career.

    “From the moment Khyree was drafted and showed up here, he had a unique journey up until that moment,” Vikings head coach Kevin O’Connell said in a press conference at the time of Jackson’s death. 

    “… Throughout the draft process and then his early time being a Minnesota Viking, you felt a guy that had such a laser focus on what his mission — his plan — was. And it really showed up in the spring. He had a very, very good spring, and was really looking forward to coming back to training camp and being well on his way to that path to having a big impact on our team for this year.”

  • Sheng Thao, ex-Oakland mayor, indicted in FBI investigation


    Former Oakland Mayor Sheng Thao has been indicted by a federal grand jury on criminal charges related to an FBI bribery case, the Department of Justice announced Friday, six months after agents raided her home and two months after she was voted out of office.

    Thao’s longtime boyfriend, Andre Jones, and David Duong and his son, Andy Duong, were also charged in the indictment.

    U.S. Attorney Patrick D. Robbins said the defendants used bribes, mail fraud, wire fraud, and other illegal practices to manipulate and corruptly influence local government.

    Robbins said the defendants knowingly entered into agreements “knowing that bribes would be offered and accepted by Thao and Jones in exchange for allowing the Duong’s to exercise illegal influence over the levers of city government.”

    The San Francisco Chronicle was first to report this latest development. 

    Thao, Jones, and the Duongs appeared before a judge at the United States Courthouse in Oakland around 11 a.m. Following the arraignment, the former mayor exited the courthouse alongside her attorney, Jeff Tsai, who addressed the media on her behalf.

    “The case is built on allegations from an unknown co-conspirator that we believe when the evidence is revealed will show that my client has committed no crimes,” said Tsai. “The indictment’s timing as well, is curious, we think the timing has amplified the politicization of this issue, but it has not served the ends of justice, ensuring that everyone is treated fairly.”

    After Tsai addressed the media, he and Thao went back inside the courthouse for processing by U.S. Marshals on the federal charges. She was then interviewed for pre-trial services. She appeared calm and was quiet.

    A federal judge said Thao is free on an unsecured bond with travel limits. She must surrender her passport.

    When did it start?

    What we know:

    According to the indictment, the illegal dealings began in October 2022, before the November Oakland mayoral election. Before the election, Thao allegedly made promises that would benefit the Duong family if she were elected.

    “Examples of promises allegedly made by Thao included her agreement to purchase housing units from a company owned by the Duong family, her agreement to ensure the extension of a contract for recycling services that the City of Oakland had with one of David and Andy Duong’s companies, and her agreement to use influence to help appoint a high-level city official to benefit the Duong’s business interests.,” said Robbins.

    The exchange

    Federal officials said that in exchange for Thao carrying out her commitments, the Duongs made payments to Thao and her boyfriend in various forms, including funding a $75,000 negative mailer campaign targeting her political rivals. The Duong family also made $95,000 in payments to Thao and her boyfriend disguised as wages for a no-show job for Jones. The payments were made to look as if Jones had a legitimate job with the Duongs housing company to cover up the bribery. 

    Federal officials said Thao directed that the payments be made to Jones to avoid a “paper trail.”

    Once Thao was elected, she fulfilled her promise to use her influence to appoint an Oakland city official, selected by the Duongs, to protect the family’s business investments, including the housing company and recycling business. That city official is not named in the indictment.

    FBI raid at Thao’s home

    The backstory:

    Thao’s home was raided by the FBI in June, though at the time, the agency would not confirm what they were investigating.

    “The FBI is conducting court-authorized law enforcement activity on Maiden Lane. We are unable to provide additional information at this time,” the department said in June.

    FBI agents were seen coming in and out of the Maiden Lane home with gloves and badges.

    Thao was not seen at the home when agents carried out the raid.

    At least three other locations were also raided in 2023 and were being investigated by the FBI, including 1211 Embarcadero, the location of Cal Waste, owned by the Duong Family.

    The two other locations were also associated with the Duong family, on View Crest Court and Skyline Boulevard.

    At the View Crest home, a neighbor who wished to remain anonymous told KTVU in June he saw two people in handcuffs at the home, as FBI agents continued their investigation.

    Who is the Duong Family?

    The Duong family is heavily involved in politics and fundraising for politicians in state and local government. The IRS also confirmed with KTVU that their criminal investigation agents were at the scene of Cal Waste on Embarcadero for law enforcement reasons.

    The Duong family owns Cal Waste Solution. David Duong and his son Andy Duong are the only members of the family charged.

    Winston Chan, an attorney for Andy Duong, told KTVU in a statement that his client is innocent and that the allegations have no merit.

    “We have kept quiet despite the media frenzy of the past months in the hope that the government would correctly come to see through objective investigation that the allegations are baseless, and being fanned by nothing more than gossip and supposition stitched together by the fabrications and delusions of those who lack all fundamental credibility,” said Chan. “But disappointingly, Andy instead is today the most recent in a long line of Asian Americans who unfairly are singled out and forced to pay a price for daring to be active in the political sphere.  We look forward to clearing his good name before the court and a jury of his peers.”

    Who is Andre Jones?

    Following the FBI raid of Thao’s home, Oakland City Attorney Barbara Parker was required to hand over documents to federal officials, including those related to Andre Jones.

    Parker was instructed to preserve and provide documents and communications tied to Jones, who had been the assistant chief for the State Bureau of Cannabis Control. He has been Thao’s romantic partner for 10 years. The two met when he was chief of staff for Councilwoman Rebecca Kaplan, where Thao also worked.

    Federal agents requested documents related to the 2022 Oakland mayoral election and all calendar entries involving Thao and Jones from June 1, 2022, to the present.

    The other side:

    Thao has consistently said she is innocent of any crime or wrongdoing.

    “I am 1,000% confident that I will be vindicated,” Thao said in 2024.”I still have the same questions. What was the probable cause to come into my home, to make this huge scene? You know, at the end of the day, the reason why I’m still making sure that we’re moving with all the successes in the city of Oakland is because I know I did nothing wrong.”

    Thao’s recall

    Thao was recalled by Oakland voters in the November election. Thao’s recall, along with former District Attorney Pamela Price, were the first successful recalls in the city’s history.

    The last time a mayoral recall vote occurred in Oakland was in 1917 against Mayor John Davis, and it was unsuccessful, the city clerk’s office told the San Francisco Chronicle. There were calls to recall Mayor Libby Schaaf and Mayor Jean Quan, but those efforts never made the ballot.

    Thao departs mayoral seat

    Thao departed her mayoral seat in December after the recall election. Nikki Fortunado Bas served as mayor until Jan. 6, when she assumed her role as an Alameda County supervisor. City councilmember Kevin Jenkins was appointed president of Oakland’s city council on Jan. 6, allowing him to become the city’s interim mayor. 

    Voters will choose the city’s next mayor in an April special election.

  • Derrick Todd, former Brigham doctor, indicted for rape – NBC Boston


    A former prominent doctor at Brigham and Women’s Hospital, who is accused in a class action lawsuit of sexually assaulting more than 200 patients, has now been indicted on two counts of rape.

    The indictment alleges that Derrick Todd — a former rheumatologist whose specialty involves treating inflammatory conditions of the muscles, joints and bones — assaulted two women whom he gave medical examinations to in December 2022 and June 2023 at the Charles River Medical Associates Office in Framingham, Massachusetts.

    The Yale and UMass graduate also practiced at Brigham and Women’s Faulkner Hospital in Boston where there’s a class action lawsuit against him accusing of performing unnecessary pelvic floor therapy, breast examinations, testicular examinations and rectal examinations on more than 200 women and several men ranging from teens to people in their 60s.

    The alleged abuse dates back to 2010 but came to light in 2023 when Brigham and Women’s received two anonymous complaints about Todd.

    The Middlesex District Attorney’s Office said Todd turned himself in to Framingham police on Thursday night and was held on bail. He appeared in Middlesex Superior Court on Friday.

    Prosecutors said the charges stem from the experiences of two patients, who reported going in for pelvic exams or pap smears. The patients told investigators that the exams went beyond what was “normal.”

    One patient reported being in so much pain that she screamed for Todd to stop, but said he continued. The second patient said she said she did not consent to the particular type of exam but Todd moved forward with it anyway.

    His attorney, Ingrid Martin said Todd is eager to defend himself from the allegations against him, fighting for no bail in his case and noting he has no criminal history.

    “He’s eager to come to court, and finally have a forum through which he can finally see the evidence against him and challenge that evidence,” Martin said.

    Bail was set at $10,000 cash and conditions set to surrender any passports passport and no contact with any victims.

    Dr. Derrick Todd is facing legal action from a growing number of former patients, with at least 120 joining a class action lawsuit.

    A lawyer for Todd, Anthony Abeln, has previously said that his client would “not litigate this matter in the media, but he will defend his care as the case progresses through the Massachusetts Superior Court system.”

    In September, Todd reached a voluntary agreement with the Board of Registration in Medicine to stop practicing medicine anywhere in the country.

  • A doctor accused of sexual abuse by more than 200 former patients is indicted on rape charges


    A grand jury in Massachusetts has indicted a doctor who is accused of sexually assaulting more than 200 former patients over a period of more than a decade.

    The patients sued Dr. Derrick Todd, who has been accused of performing unnecessary pelvic floor therapy, breast examinations, testicular examinations and other unwarranted procedures on patients dating back to 2010. The Middlesex District Attorney’s Office said in a statement Thursday that Todd was indicted earlier that day for “two counts of rape alleging the sexual assault of two women.”

    Todd pleaded not guilty during an arraignment on Friday. The district attorney’s office said the two alleged assaults took place in December 2022 and June 2023, and that additional investigations into Todd’s conduct are ongoing.

    The criminal case against Todd will likely grow, said William Thompson, an attorney with Boston firm Lubin & Meyer, which represents more than 180 of the accusers.

    “It’s just the beginning of the criminal case against Dr. Todd, but it does help validate the civil claims that Lubin & Meyer is pursuing on behalf of so many of his former patients,” Thompson said. “Fundamentally, it’s about a doctor abusing his position. And taking advantage of patients who put their trust in him for his own personal sexual gratification.”

    Thompson added that the civil case against Todd is currently in the process of discovery. The Associated Press left a telephone message with Anthony Abeln, an attorney who has represented Todd in the civil case, and with Ingrid Martin, a criminal lawyer who has represented Todd.

    Todd is a former rheumatologist at Brigham and Women’s Hospital in Boston. The lawsuit against him accused several other defendants, including the hospital, of knowing about the abuse and failing to halt it.

    Brigham and Women’s received anonymous complaints about Todd in April 2023 and launched its own investigation. The hospital fired him in July. Todd then reached a voluntary agreement with the Board of Registration in Medicine to stop practicing medicine anywhere in the United States.

    Todd’s former places of work have distanced themselves from the doctor since the allegations emerged. His accusers range from teenagers to women in their 60s.

    Paula Bliss, an attorney for victims and partner with Justice Law Collaborative, a Massachusetts legal advocacy group, said Friday that the indictment was “a resounding moment of validation for the patients he sexually assaulted and the brave survivors who came forward with the truth of this so-called medical professional’s deplorable conduct.”

  • Former Oakland mayor Sheng Thao indicted months after being recalled | Oakland


    Sheng Thao, the former mayor of Oakland, California, has been indicted by a federal grand jury, according to the San Francisco Chronicle.

On Thursday the US attorney’s office issued a press advisory stating that the FBI, US Postal Service and US Internal Revenue Service would reveal a “significant law enforcement action”, reported Oaklandside, a local news outlet.

    Thao’s brief tenure as the mayor of Oakland has been marked with controversy that culminated in her being removed from the office in a recall. The district attorney was also recalled during that election. Thao fired Oakland’s police chief, Leronne Armstrong, in February 2023. She argued that she lost confidence in Armstrong after an investigation implicated him in systemic failures within the department and after he publicly accused the federal watchdog of corruption, without evidence, the Guardian reported last October.

    She was also accused of being soft on crime which her critics say contributed to the loss of the baseball team the Oakland Athletics and the departure of chain restaurants In-N-Out and Denny’s.

    Following the June FBI raid, Thao denied any wrongdoing and argued that the raid was suspiciously timed since it came days after backers of a mayoral recall were informed by the city clerk that they had collected enough signatures to qualify for the ballot, the Guardian reported last June.

    Thao was elected as Oakland’s mayor in 2022, becoming the first Hmong American woman to lead a major US city and the youngest Oakland mayor in 75 years. Before that, she had a built a long reputation of community involvement and activism and had served as an intern for Oakland’s vice-mayor Rebecca Kaplan. She had pledged to fill vacancies in Oakland’s corruption-plagued police force and vowed to invest in violence prevention programs.

    Thao served just 18 months as mayor before a recall effort was launched – the first in the city in more than a century – bankrolled by wealthy tech and crypto executives. She was ousted in the November election.

    The Guardian reached out to Thao’s attorney Jeff Tsai for comment on the reported incoming indictment but did not get a response at the time of publication. Tsai told the Mercury News that neither he nor Thao had been contacted by the US attorney’s office and was unaware of new movement into the federal investigation.

    OAKLAND, Calif. (KGO) — Former Oakland Mayor Sheng Thao has reportedly been criminally indicted by a federal grand jury, following an extensive FBI corruption investigation.

    The East Bay Times reports her partner, Andre Jones, is also being indicted.

    More information is expected at a press conference Friday morning.

    Thursday night, ABC7 News talked the Thao’s former chief of staff.

    “Two years ago, everyone said I was lying and tonight, everyone knows I was telling the truth,” said Renia Webb. She said this moment is a reset for the City of Oakland.

    Thao was elected mayor of Oakland in 2022, and was then recalled by voters last fall.

    The news was first reported by the San Francisco Chronicle.

    “I’m honestly sad about Sheng. Again, she’s a mom. She’s very bright and smart. She just made really foolish decisions. She has to deal with the consequences of her actions,” said Webb.

    The FBI raided Thao’s home last summer along with several other locations, including properties belong to the Duong family.

    The family holds Oakland’s curbside recycling contract with California Waste Solutions. That family has been the focus of a city probe into campaign contributions.

    In front of cameras days after the raid, former Mayor Thao denied any wrongdoing.

    “I want to be crystal clear; I have done nothing wrong, and I can tell you with confidence that this investigation is not about me,” said Thao in June 2024.

    It is not clear what charges Thao faces — we reached out to attorneys and investigators but have not heard back.

    Webb testified in front of a federal grand jury last month.

    “I was informed there was pay-to-play behavior going on. That there was corrupt behavior going on in that administration,” said Webb.

    Thursday evening, ABC7 News insider Phil Matier says the federal indictment has profound implications.

    “For a long time the question was — was she involved or was she just in the room? Did something happen or was it an associate of hers? Was it her live-in boyfriend, is it other people? If this indictment comes out, then what we are saying is we know she was directly involved in some way,” said Matier.

    He went on to say, “The feds don’t mess around. If federal money is involved, they are going to do an investigation. They have zero tolerance for public officials bartering or dealing on the side.”

    Webb says let this be a lesson to other elected leaders.

    “Serve the people in the way you are supposed to with honesty and transparency and if you don’t, you are going to get recalled and you might go to jail if you are doing illegal and corrupt stuff,” said Webb.

    BATON ROUGE – TikTok creator Mr. Prada has been indicted in the September killing of Baton Rouge therapist Nicholas Abraham.

    Terryon Thomas, who uses the name Mr. Prada on social media, was indicted on first-degree murder, obstruction of justice, aggravated criminal damage to property and unauthorized use of a motor vehicle, according to court records.

    Abraham, 69, was found dead, wrapped in a tarp and dumped alongside U.S. Hwy. 51 in Tangipahoa Parish on Sept. 29.

    Thomas, 20, became a potential suspect after he was seen driving Abraham’s car. He is accused of leading police on a vehicle chase before crashing the car and running away.

    Sheriff’s office records say surveillance video shows Abraham was last seen alive outside Thomas’ apartment complex the day before his body was found.

    Abraham’s DNA was found inside Thomas’ blood-spattered apartment.

    Witnesses told deputies Thomas appeared to be struggling while dragging a blue tarp down the stairs of his apartment complex before loading it into Abraham’s car.

    Another hearing in the case is scheduled for Jan. 28.

    The man accused of setting fire to a woman who was asleep on a New York City subway has been indicted on charges of murder in the first and second degree and arson, according to Brooklyn District Attorney Eric Gonzalez.

    Sebastian Zapeta-Calil was not present at a brief court hearing Friday where the judge moved the case to Kings County Supreme Court.

    He is scheduled to be arraigned January 7.

    Zapeta-Calil, 33, is accused of setting fire to an unidentified woman who was asleep on an F train approaching the Stillwell Avenue station in Brooklyn early Sunday morning. Zapeta-Calil allegedly ignited her clothes and “fanned the flames” with a shirt as the fire engulfed her, according to police testimony in a complaint filed in Brooklyn Criminal Court.

    “These are significant counts. Murder in the first degree carries the possibility of life without parole. It’s the most serious statute in New York state law and my office is very confident about the evidence in the case and to hold Zapeta accountable for his dastardly deeds,” Gonzalez said.

    CNN has reached out to Andrew Friedman, an attorney representing Zapeta-Calil, for comment.

    The New York City Office of the Medical Examiner classified the victim’s death as a homicide, attributing it to “thermal injuries” and “smoke inhalation.”

    The victim is believed to have been homeless, which is making identification efforts difficult, law enforcement sources told CNN.

    Although the victim’s body “was badly burned,” investigators have made progress and are using advanced fingerprinting and DNA evidence to confirm her identity, the district attorney said. Dental records are typically one of the ways burn victims can be identified, law enforcement sources said.

    “Our hearts go out not only to this victim, but we know that there’s a family just because someone appears to have been living in this situation of homelessness does not mean that there’s not going to be family devastated by the tragic way she lost her life,” Gonzalez said.

    The incident has heightened concerns about safety in the subway system amid a disturbing trend of recent random attacks, drawing attention to longstanding issues that major cities like New York have faced for years, including homelessness, illegal immigration and substance abuse.

    A vigil was held Thursday night at the Stillwell Avenue station to honor the victim.

    “Her life mattered, and we believe that we can do something and that anyone can participate, and that is the power of prayer,” Rev. Kevin McCall, founder of the Crisis Action Center, told the outlet.

    Friday’s court hearing follows Zapeta-Calil’s arraignment Tuesday on charges of first- and second-degree murder and arson. He did not enter a plea.

    During his initial court appearance, Zapeta-Calil claimed to have no knowledge of the incident, noting his alcohol consumption. He did, however, identify himself in photos related to the attack, said Assistant District Attorney Ari Rottenberg.

    Zapeta-Calil was hospitalized on Monday night, which postponed his arraignment by several hours, said Helen Peterson, Brooklyn District Attorney’s Office deputy director of communications.

    An undocumented immigrant from Guatemala, Zapeta-Calil was deported in 2018 and later reentered the US illegally, according to federal immigration authorities. His last known address was a Brooklyn homeless shelter for men struggling with substance abuse, the NYPD said.

    When asked about Zapeta-Calil’s current address and shelter status, a spokesperson for the New York City Department of Social Services said, “We cannot disclose any case information about individual social service recipients and cannot comment on an ongoing investigation.”

    The US Border Patrol encountered Zapeta-Calil in Sonoita, Arizona, on June 1, 2018, issuing him an expedited removal order. He returned to Guatemala six days later, according to Immigration and Customs Enforcement spokesperson Jeff Carter. He later unlawfully reentered the US at an unknown date and location.

    This marks Zapeta-Calil’s first arrest, according to Rottenberg.

    “This is a country of immigrants,” New York City Mayor Eric Adams said on Fox 5 New York, “But those who violate that pursuit, we need to immediately remove them from our country.”

    A ‘gruesome and senseless act of violence’

    Authorities said Zapeta-Calil approached the sleeping woman silently before igniting flames that consumed her “in a matter of seconds.”

    Surveillance footage showed him sitting across from the victim before starting the fire, police said, then leaving the train and watching from outside the subway car.

    The victim, who appeared to have mobility issues and was dressed in multiple layers, remained unresponsive until engulfed in flames, sources told CNN.

    Police initially suspected the fire might have been accidental due to liquor bottles found near the victim, sources said. But a review of surveillance video shifted the investigation’s focus to Zapeta-Calil.

    He was identified and apprehended later that day after being recognized by three high school students who had seen images shared by the NYPD. Officers stopped a subway train at Herald Square, where they found him with a lighter in his pocket, NYPD Chief of Transit Joseph Gulotta said.

    In the wake of the incident, officials expressed their outrage and commitment to justice.

    “This gruesome and senseless act of violence against a vulnerable woman will be met with the most serious consequences,” Brooklyn District Attorney Eric Gonzalez said.

    “This type of depraved behavior has no place in our subways and we are committed to working hard to ensure there is swift justice for all victims of violent crime,” Adams said in a post on X.

    While much of the focus has been on Zapeta-Calil’s immigration status and the graphic nature of the crime, homeless advocates tell CNN this story also highlights a failure by state and local government to provide housing and services to people in dire need.

    Dave Giffen, executive director of the Coalition for the Homeless, says the incident highlights how homeless individuals are often politicized rather than provided with necessary housing and services.

    “What is frustrating about all this is that when these horrible incidents happen and homeless people are victimized and in the rare instance, they are the perpetrator, they are used for political purposes rather than doing something to provide permanent housing and services,” Giffen said.

    Adams, who has repeatedly suggested local law enforcement should cooperate with federal authorities on crimes committed by undocumented people, said his office is directing the NYPD to work with federal officials and assess the possibility of bringing federal charges for Zapeta-Calil.

    “Lighting another human being on fire and watching them burn alive reflects a level of evil that cannot be tolerated,” Kayla Mamelak Altus, a spokesperson for Adams, said in a statement Friday.

    “That is why, in coordination with Police Commissioner Tisch, Mayor Adams has directed the NYPD to work within our legal authority and in partnership with ICE’s Homeland Security Investigations team to explore criminal charges against Mr. Zapeta-Calil under the federal arson statute.”

    CNN has reached out to ICE and HSI on Adams’ “directive.”

    The move reflects Adams’ posture to cooperate with the federal government on violent crimes involving undocumented migrants even though Zapeta-Calil’s immigration status will not be relevant in the prosecution of the case.

    Additionally, Zapeta-Calil is already facing life in prison without parole if he is convicted of murder in the first degree. Charges from a potential federal indictment would not necessarily strengthen the outcome of the case.

    Gonzalez, who spoke to reporters outside court, appeared to downplay the mayor’s suggestion. “I think that this crime took place in New York City, in Brooklyn, and that the people of this county should serve on the jury,” the Brooklyn DA said.

    “Second, very simply state law is more significant in this case. Given the heinous nature of this case, I believe that the maximum penalty should be imposed and currently that would be in state court.”
