  • Federal Judges Already Getting Annoyed With Trump’s Lawless Horseshit


    The subjects of Howell’s order were Nicholas DeCarlo and Nicholas Ochs, two Proud Boys who admitted to throwing smoke bombs at Capitol police officers, entering restricted areas at the Capitol, and stealing plastic zip-tie restraints. “We’re not supposed to be here,” Ochs said to DeCarlo, who replied, “We’re all felons, yeah!” DeCarlo also apparently failed at his first attempt to lob a smoke grenade, saying, “Oh fuck, I just threw it without pulling the pin. Goddammit.”

    Even when the federal government decides to stop prosecuting a defendant, courts may still require the government to “submit a statement of reasons and underlying factual basis, which must be substantial to justify the dismissal and not a mere conclusory statement.” Here, the government filed a one-page motion to dismiss, with a one-paragraph explanation that cited Trump’s proclamation. “The government’s cursory motion provides no factual basis for dismissal,” Howell wrote. “This Court cannot let stand the revisionist myth relayed in this presidential pronouncement.”

    Howell ultimately dismissed the Nicholases’ insurrection-related indictments, but did so without prejudice. This preserves the opportunity for a future administration to prosecute DeCarlo and Ochs for their conduct at the Capitol. In other words, Howell knew that justice would be delayed, but she tried to find a way to make sure it might not be denied. 

    Sometimes, the pool of possible judicial decisions doesn’t include anything affirmatively good. The options are instead making something harmful a bit less bad or harder to achieve, or calling a lie a lie a little louder. In this case, Howell basically only had her voice. But at least she used it.



    In recent weeks, federal judges across the country have been expressing their frustration with President Trump’s blatant disregard for the rule of law. From his attempts to undermine the election results to his refusal to comply with court orders, Trump’s lawless behavior has not gone unnoticed.

    One federal judge in particular, Judge Emmet Sullivan, has been vocal in his criticism of Trump’s actions. In a recent ruling, Sullivan called out the administration for its “unprecedented disregard for the law” and warned that its actions could have “grave consequences for our democracy.”

    Other judges have also expressed their exasperation with Trump’s disregard for legal norms. Judge Amy Berman Jackson, who presided over the Roger Stone case, criticized Trump for his attempts to influence the case and called his behavior “inappropriate and unprofessional.”

    As Trump continues to flout the law and challenge the norms of our democracy, federal judges are making it clear that they will not stand for his lawless horseshit. It remains to be seen how the courts will ultimately respond to Trump’s actions, but one thing is clear: the judiciary is not pleased with the president’s behavior.

    Two veteran Iranian Supreme Court judges known for handling high-profile cases were shot dead inside the court in Tehran, state-affiliated media reported.

    The Iranian judiciary said the assailant – who had no pending legal cases – killed Mohammad Moghiseh and Judge Ali Razini in a “planned assassination” and attempted to flee before taking his own life, Mizan News Agency reported.

    A guard was injured in the attack, judiciary spokesperson Asghar Jahangir said, according to the agency.

    Moghiseh and Razini were veteran justices who for decades headed courts involved in trying protesters, artists and activists.

    Moghiseh was sanctioned by the United States in 2019 for overseeing “countless unfair trails, during which charges went unsubstantiated and evidence was disregarded.” He was sanctioned by the European Union eight years prior.

    In one case alone he sentenced eight Iranian Facebook users to a combined 127 years in prison for anti-regime publicity and insults to religion. He had also tried filmmakers and poets for “propaganda against the state,” the US Treasury Department said.

    In another case in 2019, he sentenced prominent Iranian human rights lawyer and women’s rights defender Nasrin Sotoudeh to 33 years in prison and 148 lashes, according to Amnesty International.

    In 1999, Razini survived an assassination attempt after a bomb was attached to his vehicle, Iran’s Fars news agency said. Along with former president Ebrahim Raisi, he is accused of being one of the judges involved in the “Death Commission” – an infamous committee that oversaw the prosecution and execution of thousands of political prisoners in 1988.

  • Two Iranian ‘judges of death’ gunned down in Tehran


    An armed assailant fatally shot two notorious Iranian judges inside the Islamic Republic’s supreme court on Saturday.

    Judges Mohammad Moghiseh and Ali Razini were known for ordering harsh sentences, including executions, during their decades-long careers. Such judges are known as “judges of death” and “executioners” in Iran.

    Iran’s judiciary said a “planned assassination” was carried out by “an armed infiltrator” inside the supreme court building in Tehran, the capital.

    “Based on preliminary investigations, the individual in question neither had a case in the supreme court nor was a visitor to its branches,” the judiciary said in a report.

    The assailant shot the supreme court judges before “quickly committing suicide”.

    Foreign involvement not ruled out

    Asghar Jahangir, a spokesman for Iran’s judiciary, told state television that the assailant was armed with a handgun.

    “At around 10 to 10.45 this morning, the assailant entered the offices of two brave and experienced judges of the judiciary inside the supreme court,” he said.

    “We don’t know the motive behind the assassination, as the assailant killed himself while fleeing the scene, but we are investigating,” he added.

    While no group has claimed responsibility, Iran’s judiciary did not rule out foreign involvement.

    “It is worth noting that over the past year, the judiciary has carried out extensive actions to identify, pursue, arrest, and prosecute individuals and elements affiliated with the evil Zionist regime, America’s allies, spies, and terrorist groups.”

    The building was evacuated following the shooting.

    Directly involved in crimes against humanity

    The shooting marks one of the most significant attacks on Iran’s judiciary in recent years.

    Both Ayatollahs held high-ranking positions in Iran’s judicial system.

    Moghiseh, who faced sanctions from the United States and European Union for human rights violations, had issued more than 1,600 years in combined prison sentences across 335 cases in recent years, according to human rights groups.

    He was particularly known for prosecuting political prisoners following Iran’s 2009 presidential election protests.

    Razini, who headed Branch 41 of the supreme court, had previously survived a car bombing attempt in 1999.

    His career included serving as Tehran’s Revolutionary Prosecutor and holding various high-ranking judicial positions.

    He was also involved in trials related to the 1988 mass executions in Iran when thousands of political prisoners were sent to the gallows.

    “Mohammad Moghiseh and Ali Razini were directly involved in crimes against humanity and continued their atrocities until the last days of their lives by approving the execution sentences of [the regime] opponents,” said Mahmood Amiry-Moghaddam, director of Norway-based Iran human rights organisation.

    ‘We should put explosives in your mouth’

    Former Iranian prisoners whose cases were overseen by the judges took to social media to share their experiences following the shooting.

    “Judge Moghiseh sentenced me to nine years in prison in a court session that lasted less than nine minutes,” one former prisoner said.

    “On the day of the trial, when I came out of his office, I saw two young men in the worst possible condition … I asked the guard why they were tied up like that, with an ugly smile, he replied, ‘Judge Moghiseh has sentenced them to death.’”

    Another former prisoner said, “Moghiseh was the judge in my case. He said, ‘We should put explosives in your mouth and blow it up.’”

    Congestion pricing ruling: New Jersey says MTA can’t implement toll on Sunday after judge’s opinion


    NEW JERSEY — After New York state said it would move ahead with implementing congestion pricing on Jan. 5 following a judge’s ruling Monday evening, New Jersey fired back, saying the MTA can’t move forward with the plan.

    In the opinion, Judge Leo Gordon rejected most of New Jersey’s complaints about the impact of the pricing scheme, but said some of the effects on New Jersey communities merited further study, specifically air quality concerns.

    After the ruling, New York state said they could move ahead with the start date despite the opinion, but New Jersey said later Monday evening not so fast.

    “We welcome the court’s ruling today in the congestion pricing lawsuit. Because of New Jersey’s litigation, the judge has ordered a remand, and the MTA therefore cannot proceed with implementing the current congestion pricing proposal on January 5, 2025,” according to a statement from Attorney for the State of New Jersey Randy Mastro.

    The judge set a deadline of Jan. 17 for New York to respond to concerns. However, congestion pricing – a program to charge drivers heading into the heart of Manhattan – is scheduled to begin on Jan. 5.

    The opinion said, in part: “Accordingly, the court will remand this issue for further explanation, and if appropriate, reconsideration of the rationale providing for differing levels of mitigation commitments for the Bronx as compared to potentially significantly affected areas in New Jersey and the ultimate mitigation determination.”

    MTA Chair and CEO Janno Lieber said in a statement the agency was full speed ahead on implementation.

    “We’re gratified that on virtually every issue, Judge Gordon agreed with the New York federal court and rejected New Jersey’s claim that the Environmental Assessment approved 18 months ago was deficient. Most important, the decision does not interfere with the program’s scheduled implementation this coming Sunday, January 5,” Lieber said.

    The statement continued: “On the two remaining issues where the Judge requested that the Federal Highway Administration (FHWA) provide additional data – information that was not yet before the Court in this proceeding — we’re confident that the subsequent Federal actions, including the approval of the revised, reduced toll rates, did put those issues to rest.”

    This could be met with a legal challenge from New Jersey officials, who the judge has agreed with in part.

    Indeed, New Jersey’s Mastro said Monday:

    “The judge determined that the Federal Highway Administration acted arbitrarily and capriciously in approving the MTA’s plan, that the FHWA’s decision provided no rational explanation of mitigation commitments, that New York changed its tolling scheme significantly after it gained federal approval, and that more consideration is needed before the current congestion pricing proposal may take effect.”

    Mastro said New Jersey remained “firmly opposed to any attempt to force through a congestion pricing proposal in the final weeks of the Biden Administration.”

    At issue is the potential environmental impact on North Jersey, when an onslaught of drivers will take the George Washington Bridge to avoid paying the new toll.

    “By remanding this case, the judge has actually confirmed what we’ve thought all along. This is going to cause a massive amount of cancer causing pollution in northern New Jersey. It’s going to mess up traffic further in the region,” Congressman Josh Gottheimer told Eyewitness News.

    What the court’s decision does not address is the January 5th start date which has Governor Kathy Hochul taking a victory lap too.

    In a written statement it part reads, ” Despite the best efforts of the State of New Jersey trying to thwart New York’s ability to reduce congestion on our streets while making long-overdue investments in public transit, our position has prevailed in court on nearly every issue. This is a massive win for commuters in both New York and New Jersey.”

    “I think that we’ve gotten the last piece of good news for the puzzle that we need to start on January 5th” said Lisa Daglian, Executive Director, Permanent Citizens Advisory Committee to the MTA.

    Now the Federal Highway Administration has until January 17th to provide more details about mitigation to any environmental effects and New York and New Jersey have until January 29th to respond to the updated report.

    So what does that mean for drivers come Sunday?

    “There will be different responses that will that will have to happen over some time, but it will have started,” Daglian said.

    What is clear is that both New York and New Jersey feel empowered by this ruling, and neither side is backing down.

    We hear the mom-to-be is expecting a baby girl.

    Judge, 32, and Bracksieck, 31, met as teenagers at Linden High School in California and later attended college together at Fresno State.

    The pair, who never publicly announced their engagement, tied the knot in December 2021.

    Photos from their wedding at the Montage Kapalua Bay resort in Maui, Hawaii, revealed that several of Judge’s teammates, including Gary Sanchez and Gleyber Torres, were among the guests.

    While Judge and Bracksieck are notoriously private about their relationship and rarely post about each other on social media, he shared earlier this year that she helped him secure a $360 million contract with the Yankees in December 2022.

    “Sam and I were headed to Hawaii to celebrate our anniversary. We had a flight at 8 a.m., so 2 o’clock in the morning, 3 o’clock, we’re just staying up … we’re going back and forth about different offers from different teams. ‘What do you want to do?’ And I’m telling her, ‘I want to stay in New York. I don’t want to go anywhere else,’” he recalled on the “Casa De Klub” podcast in July.

    “The conversations with New York really weren’t going anywhere. She was like, ‘Call Hal [Steinbrenner]. Just call him up. Tell him how you’re feeling. Tell him what you think.’”
