  • Lawsuit says ex-Yankee Rivera failed to protect abused girl


    NEW YORK — New York Yankees legend Mariano Rivera and his wife are accused in a lawsuit of failing to protect a young girl who was sexually abused by an older child during a summer camp trip sponsored by their church.

    In a lawsuit filed this month, lawyers for the girl allege that the Hall of Fame pitcher and his wife, Clara Rivera, a pastor at the Refuge of Hope Church, flew from New York to Florida to investigate after the girl’s mother expressed concerns about her daughter’s safety during the 2018 trip.

    But rather than take action, the couple “isolated and intimidated” the victim into remaining “silent about her negative experiences,” including the abuse, the lawsuit says.

    Joseph A. Ruta, an attorney for the Riveras, said in a statement that any allegations that they “knew about or failed to act on reports of child abuse are completely false.” He said the couple only learned of the allegations in 2022 after receiving a letter from an attorney requesting a financial settlement.

    “The Riveras are known throughout New York for their charitable work and especially for their commitment to serving underprivileged children,” Ruta said. “It’s unfortunate they are being targeted by false allegations.”

    The lawsuit doesn’t name the accuser, but it says she was born in 2007, which would have made her 10 or 11 years old in 2018.

    That summer, according to the complaint, Clara Rivera persuaded a congregant to allow her daughter to attend a camp at the Ignite Life Center, a church in Gainesville, Florida.

    While staying in an unsupervised dorm room, the girl was repeatedly sexually abused by an older female camper, according to the suit. In a police report filed in 2022, the girl said there were 15 instances of inappropriate touching over a two-week period, both in her bunk and a shower.

    Though the girl did not report the abuse, her mother grew worried about her safety after the two spoke on the phone call, the complaint states. The mother then outlined her concerns to Clara Rivera, who agreed to investigate, according to the suit.

    During that trip, the couple “received information that should have given them concern,” the lawsuit says, but they chose instead to remain silent to “avoid the potential scandal of child sexual abuse in its programs.” The suit doesn’t specifically state what the Riveras were told by the girl or her mother.

    The girl later returned to New York and continued her active participation in the church. But later that summer, during a barbecue for congregants at the Riveras’ home in Rye, New York, she was again abused by the same person, the complaint states.

    “They failed to mitigate the risks, and upon learning that she had been a victim, took no steps to protect her or get criminal justice,” the attorney who filed the lawsuit, Adam Horowitz, told The Associated Press by phone. “They continued to expose her again to the same risk at her home.”

    In 2021, the girl was again sexually assaulted, this time by a male youth leader at Refuge of Hope, according to the lawsuit. The abuse in that case was discovered by the girl’s mother, who found months of electronic communications between the two, the lawsuit contends.

    Afterward, the girl and her mother filed police reports in New York and Florida regarding the abuse in 2018 and 2021. Horowitz said he didn’t believe that criminal charges were brought in any of the cases. The lawsuit was filed against the Refuge of Hope church, not against the Riveras themselves.

    Prosecutors in New York and Florida didn’t immediately respond to requests for comment about whether they looked into the allegations.

    A lawyer for Ignite Life Center did not respond to an inquiry. The church recently settled lawsuits brought by three people — also represented by Horowitz — who said they were abused as teenagers by a volunteer at Ignite Life Center. Two others affiliated with the church have been charged with lewd and lascivious battery against minors.

  • Mariano Rivera Denies Covering Up a Report of Sex Abuse


    Good morning. It’s Friday. We’ll look at a lawsuit that accuses Mariano Rivera, the Yankees Hall of Famer, and his wife of covering up the sexual abuse of a minor.

    Refuge of Hope paid for the girl to attend the program, and she stayed in a dorm with other children, without parental supervision, the complaint says. The girl, who was about 11 years old at the time, was repeatedly sexually assaulted by an older female camper while she was in the Florida program, the complaint adds.

    The girl’s mother became worried for her daughter’s safety after speaking with her and brought her concern to Ms. Rivera, who said she would investigate the matter and respond accordingly, court records say.

    According to the complaint, the Riveras flew down to Florida and received information that suggested the girl was being abused but did not report it and “intimidated” the girl into silence to “avoid the potential scandal of child sexual abuse” in the Refuge of Hope programs.

    The complaint says the girl was assaulted again later that summer by the same camper during a barbecue for church youths at the Riveras’ home in Rye, N.Y. She was also sexually assaulted several times and forced to engage in explicit communications by another church employee about three years later, the complaint adds.

    The suit alleges that neither the church, its employees nor the Riveras did anything to report the abuse or properly investigate it. In December, Assemblies of God affiliates in Florida settled three lawsuits in connection with allegations of sexual assaults of minors, and a former Ignite Life Center staffer also took a plea agreement in a case linked to sexual abuse charges.

    Ruta said the Riveras had not learned about the accusations until 2022, when a lawyer in New York sent them a letter requesting a financial settlement, nearly four years after the abuse reportedly occurred. He said the couple had received another letter a year later from a law firm in Florida, again requesting a financial settlement.

    “The lawsuit, which seeks financial damages for the Riveras’ alleged failure to act on alleged incidents that were never reported to them, is full of inaccurate and misleading statements which we have no doubt will not hold up in a court of law,” Ruta said.

    I started traveling to New York City from my hometown, Toronto, in the early 2000s. I would visit once or twice a year, usually with my children. As they have gotten older, I’ve been making my annual trip solo.

    On my most recent trip, in November 2024, I stayed near Lincoln Center. When it was time to leave, the hotel doorman hailed me a taxi to take me to the airport.

    After I got into the cab, the driver and I began chatting about the delicious smelling rice and oxtail stew his wife had just dropped off for him. He told me we had spoken previously about Indian and Senegalese food. I must have looked confused because he then claimed that he knew me.

    I said that my son’s girlfriend was from India and that she had made us a feast for Diwali the year before. The driver nodded and said I had told him that before.

    I had not been to New York in a year and was incredulous that this man could possibly have remembered a random conversation with a passenger from 12 months ago.

    Then, suddenly, I remembered him, too. He had told me the last time we spoke that he was sending one of his teenage children to live with his parents for a while so they could get to know one another.

    He explained this time that the child was back home and that all had gone well.

    After getting out of the cab at the airport, I turned back to him.

    Refuge of Hope is part of the broader Assemblies of God religion and organization.

    The lawsuit, filed by the girl, now 17, and her mother, neither of whom is named to protect their privacy, is seeking unspecified damages for negligent supervision and premises liability. The Riveras are identified for their alleged roles but are not named as defendants.

    According to the lawsuit, Clara Rivera, who serves as a pastor at the church, told the mother that the girl should take part in a summer internship through Ignite Life Center in Gainesville, Florida, another Assemblies of God church.

    The complaint alleges that Refuge of Hope paid for the girl to attend and required her to stay in a dormitory with other children without parental supervision. Court documents say that an older female camper, identified in the lawsuit only as “MG,” repeatedly sexually assaulted the girl, who was about 11 at the time, in the dorm and shower.

    The girl told her mother about the abuse, and the mother then reported her concerns to Clara Rivera, who told the mother that she would investigate and get back to her, the lawsuit said. But the situation was not rectified, court documents say, and the Riveras allegedly told the mother that the girl was “safe and in no danger.”

    “Rather than take sufficient action to end the sexual abuse of Jane Doe, the Riveras each separately isolated and intimidated Jane Doe to remain silent about her abuse by ‘MG’ to avoid causing trouble for Refuge of Hope and the Ignite Life Summer Internship,” the complaint states.

    The abuse continued at the Riveras’ home during a barbecue after the girl returned from the internship, according to the lawsuit. The couple allegedly did not invite parents to the event, only the church’s children, and the girl was left unsupervised with “MG,” even after the disclosure of the abuse.

    The Riveras are accused of failing to take appropriate action and handling the allegations internally to “avoid scrutiny, public scandal, and potential financial losses from allegations of child sexual abuse becoming public information,” the lawsuit reads.

    A Refuge of Hope youth leader, Ruben Tavarez Jr., who is the son of an associate pastor, is also accused of abusing the girl in 2021, which included “graphic electronic communications of a sexual nature.” It ended when the girl’s mother confronted Tavarez, according to the lawsuit.

    Last month, affiliates of the Assemblies of God settled three lawsuits that alleged similar abuse of minors. A former staff member of Ignite Life Center entered into a plea agreement in connection with sexual abuse.

    Joseph A. Ruta, the Riveras’ attorney, released a statement saying that the couple “do not tolerate child abuse of any kind” and that the allegations are “completely false.”

    “The very first time they heard about these allegations was nearly four years after the alleged incident, when in 2022 a New York attorney sent a letter requesting a financial settlement,” Ruta said. “This was followed by a second letter in 2023, from a different Florida law firm, again requesting a financial settlement.

    “The lawsuit, which seeks financial damages for the Riveras’ alleged failure to act on alleged incidents that were never reported to them, is full of inaccurate and misleading statements which we have no doubt will not hold up in a court of law.”

    Once Major League Baseball’s most authoritative closer, garnering the all-time highest Hall of Fame voting percentage – a perfect 100 percent – Rivera, 55, later became the lead pastor at the Refuge of Hope church in New Rochelle, 15 miles north of The Bronx.

    But last Thursday, a legal complaint was filed in the Supreme Court of Westchester County accusing the Riveras of being negligent in their supervision and allegedly failing to act upon learning that a young girl from their church was being sexually abused.

    A Florida Pentecostal church affiliated with Refuge of Hope and the couple’s one-time New York home are at the center of the alleged scandal.

    According to the filing in the civil case, the plaintiff – known as “Jane Doe” – claims she was sexually abused by an older minor girl – anonymised as “MG” during a summer internship in 2018 at the Ignite Life Center in Gainesville, Florida, which was supported by Rivera’s church.

    The victim and her family were also members of Refuge of Hope in New York, the suit alleges. A year after the alleged abuse began, Mariano Rivera was awarded the Presidential Medal of Freedom by President Donald Trump.

    Clara Rivera, who is said to be in charge of Refuge of Hope’s day-to-day operations, allegedly convinced the girl’s mother to allow her to attend internship, according to the complaint.

    The lawsuit states that the Riveras traveled from New York to Florida to see the victim at the summer camp where they “learned or should have learned information” about the sexual abuse.

    The complaint read: “Rather than take sufficient action to end the sexual abuse of Jane Doe (the victim), the Riveras each separately isolated and intimidated Jane Doe to remain silent about her abuse by MG (the suspect) to avoid causing trouble for Refuge of Hope and the Ignite Life Summer Internship.”

    The girl is said to have returned to New York after the Ignite Life Center Summer Internship ended and resumed church services at Refuge of Hope.

    Rivera has a long history of friendship with Ignite Life Center’s head pastor Mark Vega who was a former chaplain with the Yankees during the Panama City native’s playing days.

    The abuse allegedly continued at a barbeque hosted at the couple’s former Brook View property in Rye, New York, in August 2018 before it was sold in June 2022 according to the complaint.

    The girl was also alleged she was sexually abused by Ruben Tavarez Jr., the adult son of the Refuge of Hope Associate pastor Ruben Tavarez Sr., in August 2021.

    The suit argues that the Riveras failed to adequately supervise or act on known risks, leading to these incidents.

    Mariano and Clara Rivera “falsely promoted their activities and premises as being safe, moral, and otherwise free of a risk of harm when it knew or should have known otherwise,” the complaint states.

    The complaint also sheds light on a pattern of alleged negligence at Ignite Life Center.

    Three individuals have been arrested for child sex crimes, including former volunteer Gabriel Hemenez who was sentenced to five years in prison for two felony counts of molesting a minor in March 2024.

    The son of the church’s head pastor Christian Vargas who was also charged with sexual battery of a minor in July 2023 and son of a former associate pastor Noel Cruz who was sentenced to three years probation earlier this month for sexual battery of a minor.

    Vargas has entered a not-guilty plea in his case as he continues to await trial.

    He’s a good guy who overcame significant personal adversity during his Washington reign. But the game passed him by.

    Jones’ handling of team affairs in Dallas is coming in for increased criticism. The Cowboys are already behind in their head coaching search after he took so long to part ways with Mike McCarthy. Leading candidates are already taking jobs elsewhere. The links to Deion Sanders have subsided for now, so there’s just no telling how this is going to play out.

    Rivera is experienced, but this would be an underwhelming hire. However, it would allow Jones to be the center of attention as always. That wouldn’t be the case if Sanders got the keys to the kingdom.

    That’s all Jones seems to care about. If people are talking about the Cowboys and he’s making money, that suffices despite nothing but perennial underachievement for three decades.

    It might (and probably will) come to nothing. But Rivera going to Washington’s bitter division rival wouldn’t exactly leave anybody in D.C. shaking with fear.
