Immigration attorney speaks on ICE operations in the Rochester area
Rochester, N.Y. (WHAM) — Since last Thursday, the U.S. Immigration and Customs Enforcement (ICE) has arrested 4,500 people nationwide, including an unspecified number in the Rochester area.

The operations have caused panic among some community members. 13WHAM talked Tuesday to immigration attorney Anthony Guidice about the situation.
“I’ve gotten calls all morning, yesterday, this morning,” said Guidice, who has received numerous reports of ICE activity in Rochester, Henrietta and Geneva.

Guidice expressed concern over the tactics used by ICE.
“I haven’t talked to anybody that’s committed any crimes,” he said. “They’re just going after undocumented people.”
Guidice emphasized that ICE agents should have warrants signed by a judge when conducting searches or making arrests.
“I don’t think they’re using any warrants,” he explained. “Technically, you should have a warrant unless the subject is going to flee imminently. That’s what their guidelines are, but a lot of times they just ignore that. They just go up to the person, and people usually scared to death, and they freeze and they submit.”
Guidice noted that there is little advice to offer undocumented individuals.
“Unless they’ve got some kind of status, the government can take them, people that are under supervised release,” he said. “They can take them immediately and get rid of them immediately. They’re not entitled to due process.”
According to Guidice, those safe from deportation include individuals with an authorized stay in the country, such as green card holders, asylum applicants, current work visa holders and people on parole.
He also clarified that there are no limitations on where ICE operations can occur.
“ICE can go into anything, they always could do that,” he said. “Sanctuary cities, that doesn’t mean a thing. All that means is that the government, the state employees, the state authorities will not take federal action against them. That’s all sanctuary means doesn’t protect them.”
Reports have surfaced of ICE visiting schools during recent operations, which Guidice confirmed has always been allowed, with the frequency varying based on the administration.

22-year-old man arrested for Rochester bank robbery
Rochester, N.Y. — Police are investigating a bank robbery on the city’s west side.
Officers responded to KeyBank on Lyell Avenue near Plymouth Avenue shortly after 9 a.m. for a report of a hold-up alarm.
The bank teller told police the suspect whispered that he had a bomb and to give him money.
The suspect reportedly fled after the teller handed over money from a drawer. No injuries were reported.
Officers took Kevis Herd, 22, into custody after a foot chase on Parkway near Lorimer Street.
Herd is charged with first-degree robbery and was taken to the Monroe County Jail. His arraignment is scheduled for Tuesday morning.
On Tuesday afternoon, a 22-year-old man was arrested in connection with a bank robbery that took place in Rochester earlier in the day. The suspect, whose name has not been released, allegedly entered the bank wearing a ski mask and demanded money from the teller before fleeing the scene.Police were able to track down the suspect thanks to surveillance footage and witness descriptions. He was taken into custody without incident and is currently facing charges of armed robbery.

Rochester Kwanzaa Coalition brings vibrant celebration to City Hall with music and dance

AG releases video showing inmate from Rochester beaten before death at NY state prison
ROCHESTER, N.Y. (WHAM) — New York Attorney General Letitia James released body-worn camera video Friday from Marcy Correctional Facility showing officers beating an inmate who died the next day.

Video from Dec. 9 showed Robert Brooks, 43, of Rochester, being beaten by several officers.
James noted the officers left their cameras on standby mode, only recording video and not audio.

Brooks was more than halfway through a 12-year sentence, which began in 2017, for first-degree assault.

That is why I ordered an immediate and full investigation into the death of Robert Brooks and further directed DOCCS Commissioner Martuscello to begin the termination process for the 14 individuals who were involved in his fatal attack. The State of New York has zero tolerance for individuals who break the law, and I am committed to holding everyone involved fully accountable. Once again, I want to offer my deepest condolences to Mr. Brooks’ family and loved ones as they grieve his tragic death. I am grateful to the Attorney General and her team, our State Police, and everyone working with us to ensure justice is served in this case.
