  • bne IntelliNews – Families of Karabakh Armenian leaders condemn sham trials in Azerbaijan


    For David Vardanyan, September 27, 2023 is a day he’ll never forget. It was the day he awoke to photos of his father, Russian-Armenian billionaire Ruben Vardanyan, in the custody of Azerbaijani security forces.

    “It seems so long ago, more than 480 days already,” David says. “I found out about it on social media. At first, I was in complete disbelief that something like this could happen. And then I saw that these images had been posted very intentionally by Azerbaijani state media, to show every Armenian in the world that they’re no longer safe,” he says.

    Ruben Vardanyan’s arrest came amidst the dramatic collapse and complete ethnic cleansing of Nagorno-Karabakh, the ethnic Armenian-populated breakaway enclave of Azerbaijan. A week earlier, Azerbaijan had launched a full-scale offensive to finally crush all resistance in the de facto independent territory, forcing a total capitulation by the republic in just 24 hours. What followed was the complete exodus of the territory’s population, with more than 100,000 ethnic Armenians fleeing their ancestral homeland in just days, as the Republic of Artsakh came to an end.

    But not all would be allowed to leave. A number of individuals — mostly high-ranking Karabakh Armenian politicians — were detained as Azerbaijani forces took full control of the territory. These included three of the republic’s former presidents, as well as Vardanyan, who had moved to the territory in August 2022 and briefly served as its state minister. After more than a year of captivity, a series of trials against 16 of the detained, including Vardanyan, who faces life in prison, began on January 17. The proceedings to date have been extremely opaque, with only Azerbaijani state media allowed to cover them and no international observers present.

    The charges against Vardanyan and others are “purely political”, says Irene Victoria Massimino, a lawyer and professor specialising in human rights and international criminal law.

    “In the overall context of [Azerbaijan’s] persecution of Armenians, especially the Armenians of Artsakh, these charges are based only on politics. They are fabricated by Azerbaijan,” she says.

    Massimino is one of four lawyers on whose behalf the Center for Truth and Justice, a California-based, Karabakh-focused advocacy organisation, has applied for visas to Azerbaijan to observe the trials. They have yet to receive a response from Baku, but it is unlikely to matter — Massimino says the chance of anything approximating justice resulting from the proceedings is “zero”.

    “I tend to quote a lot the Freedom House report on Azerbaijan,” Massimino says. “The country scored seven points out of 100. It is absolutely unfree, and one of the main reasons for that in the most recent Freedom House report is the blockade of Artsakh [from December 2022 to September 2023] and the persecution of Armenians. So these are show trials. They are absolutely unfair and based on political charges,” she says.

    While Azerbaijan, under the autocratic rule of President Ilham Aliyev, is no stranger to abrogations of justice, the nine-month Karabakh blockade was extraordinary even by Baku’s standards. More than 100,000 Karabakh Armenian citizens were brought to the brink of starvation by Azerbaijan’s closure of the only road linking the enclave with the outside world. When the International Court of Justice ordered in February 2023 that Baku open the road and ‘ensure unimpeded movement’ between Karabakh and Armenia, Azerbaijan summarily ignored it. No consequences followed, and the humanitarian situation would continue to worsen for another seven months before Baku launched its military offensive.

    Amidst the blockade, one of the most public figures representing the people of Karabakh was Ruben Vardanyan. Vardanyan gave dozens of interviews for international media on the deteriorating conditions in Karabakh, drawing the ire of Azerbaijan, who targeted him repeatedly in scathing rhetorical attacks. His son believes that this advocacy was what led Baku to single him out.

    “One statistic that kind of drives the point home is that during the three months when Dad was state minister [November 2022 to February 2023], he gave more interviews to Western media than all the presidents of Karabakh did for 30 years combined,” David Vardanyan says. “I think the level of attention that Dad brought to Nagorno-Karabakh after he decided to live there did not fit with Azerbaijan’s playbook. They had hoped that they would slowly make things unlivable there and force people out gradually — kind of a ‘quiet ethnic cleansing’ that the world will not notice. So it’s very clear that they were not happy with the kind of attention they were now getting to the injustices being done there,” David says.

    Eventually, Baku got its opportunity to punish Ruben directly — an opportunity that the Azerbaijani government is clearly relishing. By holding such show trials against Ruben and his 15 compatriots, Azerbaijan is hoping to flex its muscles and intimidate both its neighbour, Armenia, and its own citizens, Massimino says.

    “For Azerbaijan, this is a trophy — that they finally have the leaders of the Artsakh government, who were fighting for self-determination for so long,” she says. “This constant intimidation of Armenians is intended to show power, most likely as a political tool for negotiations [with Armenia]. But I also think that it’s embedded in the DNA of authoritarian regimes that they must apprehend individuals and punish them for daring to exercise their rights. There are many other political prisoners in Azerbaijan, Azerbaijani political prisoners, who will also receive this message.” 

    Despite the obvious lack of fairness or judicial due process in the trials, they have generated almost no international response to date. With the exception of a resolution by the Parliamentary Assembly of the Council of Europe (PACE) calling for Azerbaijan to release both the detained Karabakh Armenian leaders and the many Armenian POWs held by Baku, there have been few, if any, statements by Western countries on the matter.

    “The lack of any attention by the international community [to these trials] astonishes me,” Massimino says. “Both the ‘caviar diplomacy’ and energy resources of Azerbaijan, their oil and gas, contribute to this. They have strong ties with many European countries, and it’s also a conflict that has received much less attention than other conflicts since 2020. I don’t understand why the media has put so little attention on the blockade in particular. Nine months of blockade of an entire people, and no one paid attention.” 

    David Vardanyan says that the lack of Western political pressure on Azerbaijan was sadly predictable.

    “I think the EU is completely losing its credibility when [President of the European Commission Ursula] von der Leyen calls Azerbaijan a ‘reliable partner,’” he says. 

    “And the UK in particular should be noted for its complicity and deals with SOCAR [Azerbaijan’s state oil company]. The UK has the largest leverage over Azerbaijan, as a lot of the Aliyev family’s personal wealth is invested in the UK. On the US side of things, the previous administration was terribly silent in the ethnic cleansing that took place, so I think the new administration has a challenge and an opportunity to kind of do much more,” Vardanyan says.

    In the absence of meaningful international pressure, it seems clear that Azerbaijan will continue with the trials. Massimino says that tangible steps should be taken by Western countries in response.

    “Beyond talking about the issue, [Western countries] should start to rethink their economic relations with this authoritarian regime,” Massimino says. “The level of impunity Azerbaijan has enjoyed is very, very high. So sanctions would be an option, maybe cutting some economic ties, in order to force the regime to release these prisoners, both the POWs and the former leaders,” she says.

    For David Vardanyan, all that’s left is to hope — and to savour the few minutes a week he gets to speak with his father.

    “When we speak with Dad now, we’re just trying to get as much information as possible — about his health, about what’s happened in the courtroom,” he says. “Azerbaijan has made the trial completely inaccessible; they are now even threatening to disbar the lawyer we found, with great difficulty, to represent him. They have refused all his petitions to extend the trial, to get internet access, anything that could let him prepare properly. They are getting away with complete disregard of international law and even their own laws. All we can do now is try to put this sham trial in the public eye as much as possible.” 





    The families of several prominent leaders from the disputed region of Nagorno-Karabakh have spoken out against what they describe as “sham trials” taking place in Azerbaijan.

    In a statement released by bne IntelliNews, the relatives of former Karabakh President Bako Sahakyan, former Defense Minister Jalal Harutyunyan, and others condemned the trials as a violation of human rights and a political maneuver aimed at stifling dissent.

    The families argue that the trials, which have resulted in lengthy prison sentences for the accused, are politically motivated and lack any semblance of due process. They are calling for international organizations to intervene and ensure that justice is served.

    These developments come amid ongoing tensions between Azerbaijan and Armenia over the Nagorno-Karabakh region, which has been at the center of a decades-long conflict. The families of the accused are urging the international community to pay attention to the situation and prevent further abuses of human rights in the region.

    As the trials continue to unfold, it is clear that the families of the Karabakh Armenian leaders are determined to fight for justice and accountability in the face of what they see as a grave injustice.

  • Parliament denounces the upcoming sham presidential election in Belarus | News


    Denouncing the ongoing and long-standing grave violations of human rights and democratic principles in Belarus, which have further intensified in the run-up to the so-called presidential election on 26 January, Parliament asks the EU, its member states and the international community not to recognise the legitimacy of incumbent dictator Aliaksandr Lukashenka as president after the vote. With Mr Lukashenka having ruled Belarus ruthlessly since 1994, MEPs note that, unlike in 2020 there are only pro forma ‘candidates’ to challenge him in this month’s election. While reiterating their non-recognition of Mr Lukashenka as President and their position that the entire Belarusian regime is illegitimate, MEPs express their unwavering support for the Belarusian people in their pursuit of democracy, freedom and human rights.

    Parliament wants to strengthen EU sanctions against Belarus

    MEPs are also gravely concerned about the situation of political prisoners in Belarus, of which, according to the Belarusian human rights organisation Viasna, there are over 1200. The resolution calls on the EU and its member states to continue investigating human rights abuses in the country and to support accountability measures, including through the application of the “universal jurisdiction” legal principle. MEPs also denounce the Lukashenka regime’s complicity in Russia’s war of aggression against Ukraine and condemns its deliberate subordination of Belarus to Russia in a so-called union state. They urge the EU and its international partners to broaden and strengthen sanctions against individuals and entities responsible for the repression in Belarus and for Belarus’ participation in Russia’s war in Ukraine.

    The Parliament has strongly condemned the upcoming sham presidential election in Belarus, stating that it is a blatant attempt to undermine democracy and suppress the will of the people.

    In a statement released today, members of Parliament expressed their deep concern over the current political situation in Belarus and the government’s systematic crackdown on opposition candidates and activists.

    The upcoming election, scheduled for next month, has been widely criticized for its lack of transparency and fairness. Opposition candidates have been harassed, detained, and even barred from running, while the government has resorted to intimidation tactics to silence dissenting voices.

    Parliament has called on the international community to stand in solidarity with the people of Belarus and to hold the government accountable for its actions. They have urged for free and fair elections to be held, and for the rights and freedoms of all Belarusian citizens to be respected.

    As the situation in Belarus continues to escalate, Parliament has vowed to stand firm in their support for democracy and human rights, and to continue to denounce any attempts to undermine the will of the people. They have called on all democratic nations to join them in condemning the sham presidential election and in supporting the people of Belarus in their fight for freedom and democracy.

    Belarus elections ‘a total sham,’ EU commission spokesperson says

    European Commission spokesperson on foreign affairs, Anitta M. Hipper, has just been asked about Belarus at the commission’s daily press briefing.

    This is what she said:

    This is an exercise that is totally undemocratic. These elections are a total sham. It is not elections if you already know who is going to win.

    The EU is continuing to support the Belarusian people. We are also continuing to put pressure on the regime. We have done so last December with the latest package of sanctions, targeting those responsible for human rights violations.

    We have also continued to raise awareness on all political prisoners and those unjustly detained. We are calling on the authorities to release all … people facing repression.

    When it comes to our support for the Belarusian people … we have adopted a package of 30 million euros in support of the civil society. This brings our total EU support to 170 million euros mobilised since 2020.

    Key events

    “No practical actions” from Ukraine or the West on peace talks, Russia’s Lavrov claims

    Meanwhile, Russian foreign minister Sergei Lavrov said today that he saw “no practical actions indicating that Kyiv and the West are really ready” for peace talks about Ukraine, despite US president Donald Trump’s comments that he wanted to bring the war to an end.

    According to a transcript of questions and answers on his ministry’s website, accessed by Reuters, Lavrov said:

    On the contrary, Western military supplies to the Ukrainian armed forces are continuing, ultimatums to Russia are being worked out, there is a (Ukrainian) legal ban on negotiations, and the issue of the legitimacy of the Ukrainian authorities is not being resolved.

    Back to Belarus, media watchdog Reporters Without Borders has said it had filed a complaint with the International Criminal Court against Alexander Lukashenko over alleged “crimes against humanity as journalists continue to be overwhelmingly targeted by his regime.”

    Here is what the watchdog’s head for Eastern Europe, Jeanne Cavelier, said about this Sunday’s election:

    The electoral farce will likely proceed without a hitch, free from the counterweight of independent media, ensuring Lukashenko’s victory over four puppet candidates.

    For five years, the Belarusian regime has systematically persecuted independent voices, starting with journalists.

    To combat this glaring impunity, RSF is filing a complaint for crimes against humanity committed against Belarusian journalists.

    The RSF’s findings include allegations about “589 cases of arbitrary arrests of independent media professionals in a country that had about 2,000 journalists just five years ago.”

    In September, Lithuania also said it had asked the court to probe alleged crimes against humanity by Lukashenko.

    EU foreign policy chief Kallas invites US secretary of state Rubio to Brussels

    Back in Brussels, the EU’s top diplomat, Kaja Kallas, has issued an open invitation to the new US Secretary of State, Marco Rubio, to attend a meeting with the bloc in Brussels, officials said.

    “In my letter to Secretary of State Marco Rubio, I offered an open invitation for his participation in one of our meetings at his earliest convenience,” Kallas wrote to EU foreign ministers, AFP has learned.

    Officials said there had so far been no response.

    Oops.

    The latest attempt to engage with the new US administration comes as Donald Trump ramps up his criticism of the EU. Speaking at the World Economic Forum in Davos yesterday, he raised several about what he sees as imbalances or unfair approach from the EU, and said he would “do something about it” (yesterday’s blog 17:43).

    There is also plenty to talk about regarding Russia, Ukraine, Belarus, but also China and the Middle East, among others.

    So far, the only chat we know of between a senior US administration official and a senior EU official was Rubio’s phone call with Polish foreign minister Radosław Sikorski, which the Pole revealed in a social media post.

    715,000 premises in Ireland without power after Storm Éowyn

    Speaking of Ireland, here is the latest as the country battles Storm Éowyn from our weather blog.

    Over 715,000 homes and business were without power as a result of the storm.

    Unsurprisingly, a large number of flights scheduled to operate to, from or between airports in Ireland and the UK have been cancelled, too. Dublin was the worst affected airport, with 119 departures and 109 arrivals cancelled, the PA news agency reported.

    Irish government appointments

    As promised, let’s also catch up on the new Irish government after yesterday’s delayed confirmation of Micheál Martin as the country’s new prime minister.

    Of the 15 senior ministers, it’s worth noting some of the key appointments:

    Martin’s direct predecessor, Simon Harris, takes on the role of minister for foreign affairs, defence, and trade. Under the terms of the coalition arrangement, he will get the top job again in 2027.

    Other notable names include finance minister Paschal Donohoe, who also chairs the Eurogroup, health minister Jennifer Carroll MacNeill, and home and justice minister Jim O’Callaghan.

    Helen McEntee, well known on the international stage having burnished her credentials as Europe minister during the Brexit crisis, is the new education minister.

    However, the Irish media pointed out that only three out of 15 senior jobs went to women, with the Irish Independent noting that “the number of women at the table has actually reduced, down one in comparison to the outgoing government.”

    Aldagh McDonogh, chair of the Women for Election group, said “this decline in women’s representation is concerning.”

    It is perplexing that the taoiseach and tánaiste would reject the opportunity in forming the Cabinet to ensure that women’s expertise and lived experience are equally represented at the heart of government decision-making.

    This comes after the last year’s election resulted in the lowest proportion of female parliamentarians in western Europe, with a 75:25 ratio of men to women.

    Before we look at some other events in Europe today, here’s my Guardian colleague Pjotr Sauer’s story on this Sunday’s vote:

    In 2020, accusations of electoral fraud triggered months-long demonstrations, drawing hundreds of thousands of Belarusians to the streets. The authorities detained more than 35,000 people, many of whom were tortured in custody or forced to flee the country.

    Since then, the Lukashenko regime, backed by Vladimir Putin – whom Minsk in turn supports in the war in Ukraine – has intensified its repression of even the smallest acts of dissent, charging critics with extremism and terrorism for actions as minor as leaving critical comments on social media or following so-called extremist Telegram channels.

    … and if you wonder what Lukashenko makes of all of all this criticism and what he does in the final days of the campaign, he is… just busy.

    “To be honest I don’t follow it. I simply don’t have time for it,” he told factory workers last week.

    Ah, of course.

    Earlier this week, European lawmakers urged the European Union and the international community to “not recognise the legitimacy of incumbent dictator Alexander Lukashenko as president after the vote.”

    The European Parliament’s resolution said they should

    categorically reject the upcoming elections in Belarus and the run-up campaign as a sham, as they do not meet minimum international standards for democratic elections.

    The parliament also condemned “the ongoing grave violations of human rights,” which it said “have further intensified in the run-up to the so-called presidential election.”

    It also called out “the systematic repression … which includes arbitrary arrests, torture, harassment, ill-treatment of detainees, persistent impunity and a structural lack of respect for due process and fair trials,” the text said.

    Speaking of Ukraine… here is our daily war briefing for you:

    • Russian crews were responding to an air attack in the Ryazan region south-east of Moscow over Thursday night.

    • Donald Trump has told the Davos World Economic Forum conference that he wants to meet Vladimir Putin soon and “stop this ridiculous war”.

    • “We do really welcome such strong messages from President Trump and we believe that he will be the winner. And we believe that we have an additional chance to get new dynamic in diplomatic efforts to end this war,” said Ukraine’s foreign minister, Andrii Sybiha.

    Tsikhanouskaya also spoke about concerns in Belarus that the country “might be given as a consolation prize to Putin” after any potential peace talks on Ukraine.

    “That at the moment of negotiation we might save Ukraine on some terms but Belarus will stay in the status quo and it will postpone changes in Belarus for many, many years.”

    She said the talks, if they happen, should look at the withdrawal of Russian troops not only from Ukraine but also from Belarus, including nuclear weapons.

    Belarus vote has ‘nothing in common’ with democratic elections, exiled opposition leader says

    Tsikhanouskaya, the head of the exiled Belarusian opposition, spoke with Reuters earlier this week.

    Here is what she said:

    “What in the democratic world you call elections has nothing in common with this event in Belarus. Because it’s mostly like a ritual for dictators, when they are reappointing themselves.”

    She argued that Lukashenko was playing his “usual game” of drip-feeding prisoner releases in the hope of winning rewards from the West.

    She said the exiled opposition was counting on further support from what she called the “democratic world” in its efforts to weaken Lukashenko and bring change to the country.

    Our fight is not just only for Belarus, it’s a fight against dictatorship,” she said. “We need allies in this fight.”

    Here’s more from Reuters on Lukashenko’s pardons this morning:

    Lukashenko, a close ally of Russian President Vladimir Putin, is assured of winning a new five-year term on Sunday. The exiled opposition says the vote is a sham because all his leading critics have been jailed or forced to flee the country.

    Mass protests nearly swept Lukashenko from power after the last election in 2020, when Western governments backed the opposition’s assertion that he falsified the results and stole victory from its candidate, Sviatlana Tsikhanouskaya. He used his security apparatus to crush the demonstrations, arresting tens of thousands of people.

    Human rights group Viasna, which is banned in Belarus as an extremist organisation, says there are about 1,250 political prisoners in the country, even after the release of more than 250 in the past year. Many of those freed were sick, elderly or close to the end of their sentences.

    Lukashenko issues pardons on eve of election

    So let’s go straight to Minsk, where Belarusian President Alexander Lukashenko pardoned 15 prisoners in what state media called a humanitarian gesture, two days before an election in which he is set to extend his 31-year rule.

    State media said Lukashenko had pardoned eight people convicted of extremist activity and seven sentenced for drug crimes. It did not give any of their names. Earlier this week, he signed a decree raising pensions by an average of 10%.

    Political analysts say Lukashenko is hoping to use the election and successive batches of prisoner releases to try to repair relations with the West, which has imposed waves of sanctions on Belarus over its human rights record and support for Russia’s war in Ukraine.

    His efforts have become more urgent, they say, as he contemplates the likelihood of Ukraine peace talks this year and tries to secure gains for himself and Belarus if the conflict comes to an end, Reuters reports.

    Over 700,000 premises are currently reported to be without power in Ireland this morning as Storm Éowyn, expected to be one of the most dangerous in history, makes landfall.

    The entire island of Ireland is under a red weather warning this morning. Later today, tricky weather conditions could also affect parts of continental Europe, including northern France.
