What to know about the three accidental hunting shootings over the past year
BATON ROUGE – Roberto Garcia, 61, of Baton Rouge was accidentally shot to death over the weekend while hunting on the Sandy Hollow Wildlife Management Area near Kentwood.
The Department of Wildlife and Fisheries has taken the lead in the investigation, but so far no one has been charged. He was shot by a .45 caliber muzzleloader.
It’s the second accidental hunting shooting this year, and the third if you include last season.
“It’s peak deer time–rut going on. Anybody who knows anything about deer hunting knows that Christmas and New Year’s time, it starts getting cold and deer start running, ” said Lt. Jared Riddle with LDWF.
Almost exactly one year ago, Thomas Franklin accidentally shot and killed Jacob Altazan while they were hunting on property within Baton Rouge city limits.
Baton Rouge police took the lead.
When Franklin was arrested for negligent homicide, he said he mistook Altazan for a deer. He also said no one was wearing their hunter’s orange safety vests when the shooting happened.
However, a friend of Altazan’s provided WBRZ with video which shows him in his hunter’s orange an hour before the shooting.
Whether he was wearing it at the time of the shooting is unclear.
But a hunter who was shot last week in Zachary was definitely not. LDWF, which took the lead, says neither the victim nor the shooter were.
The man survived, but agents cited the shooter for hunting deer without possessing deer tags and not wearing hunter’s orange.
LDWF says that’s why it’s a requirement.
“Sometimes there’s a question that’s asked, why do I need this hunter’s orange even if I’m on public property or private property? I think this is a very good example of clearly why we should wear it.”
LDWF has not responded to questions about whether Garcia was wearing an orange vest.
Franklin’s negligent homicide trial is scheduled to begin in August.

Downtown LA shootings: 2 security guards shot near busy shopping plaza and 2 others shot just mile away in separate incident
DOWNTOWN LOS ANGELES (KABC) — Two separate shootings within blocks of each other left four people injured, including two security guards, Monday night in downtown Los Angeles, according to police.
Shooting at busy shopping plaza
The first incident was reported just before 9 p.m. at the FIGat7th shopping center on Figueroa and 7th streets, just outside of the Target store.
According to the Los Angeles Police Department, the security guards tried to stop a shoplifting suspect when that suspect pulled out a gun and shot them.
When officers arrived, they found two security guards suffering from gunshot wounds. They were both taken to a local hospital. One of them was shot in the stomach and was listed in critical condition.
The other guard was shot in the arm and leg, and is expected to survive.
Meanwhile, Eyewitness News obtained an exclusive photo of the suspect, who remains at large. Investigators believe he is about 25 years old.
Judith Conway told ABC7 she was waiting in the checkout line when she heard gunshots outside.
“[It was] extremely loud, extremely traumatic,” she said. “We all just started running towards the back. We were guided by one of the sales reps, one of the cashiers I should say, at the front. But extremely traumatic, we heard several rounds go off, and we just pretty much ran towards the back and just left our items in the cart, and just tried to do the best that we could to get to safety.”
She recalled seeing people crying and heard several others screaming.
“Some people were running towards the aisles, some people were hiding toward the clothes, everyone just started running and scattering in different directions,” said Conway.
Two separate shootings within blocks of each other left four people injured Monday night in downtown Los Angeles, according to police.
Shooting on 7th Street and Maple Avenue
Another shooting near 7th Street and Maple Avenue, which is about a mile from the shopping mall, also injured two people, according to police.
A man and a woman were both rushed to the hospital in an unknown condition. Information on a suspect or suspects in this case was not immediately available.
Investigators do not believe that shooting is connected to the earlier shooting of the two security guards.

Bikers can face gang charges for I-11 shootings after Nevada Supreme Court ruling
LAS VEGAS (KSNV) — Seven alleged members of the Hells Angels motorcycle club can face gang prosecution for a 2022 shootout on a Henderson freeway following a Nevada Supreme Court ruling.
The high court filed a unanimous opinion Thursday deciding that the Clark County District Court erred in dismissing gang enhancements against seven men charged in the shootings.
Authorities alleged Richard Devries, the president of the Las Vegas chapter of the Hells Angels, and others waited on Interstate 11 to ambush members of the Vagos motorcycle club returning from a Memorial Day weekend event in Boulder City.

Seven people were injured in the shooting, according to Henderson Police. The seven suspects face a litany of charges, including several counts of attempted murder.
An officer with Las Vegas Metropolitan Police who specialized in investigating outlaw motorcycle clubs testified to the grand jury as an expert witness, saying that Hells Angels members can be ordered to attack if they encounter a rival club. He also said there have been other violent encounters between Hells Angels and Vagos members in Nevada and other states in the past.
The seven men charged in the shooting filed a response arguing the evidence submitted did not support probable cause for gang enhancements because they had no history of felony convictions or documented violence against rivals. A Clark County District Court judge sided with them, ruling prosecutors failed to show the Las Vegas chapter of Hells Angels engaged in criminal activity to qualify as a gang.
In their opinion, the Supreme Court justices said the LVMPD officer’s testimony is admissible and that out-of-state history can be used to determine gang activity.
The LVMPD officer’s testimony provided evidence of coordinated activities at the national and regional level, the opinion states, and there was enough evidence showing the Las Vegas chapter had ties to the larger Hells Angels organization to warrant grand jury consideration.
“Furthermore, the grand jury could reasonably infer that this violent behavior was not simply attributable to the impulses of individual members; rather, it is perpetuated and celebrated as central to Hells Angels’ customs and culture,” the court wrote.
Devries and the six other men charged—Russell Smith, Stephen Alo, Cameron Treich, Taylor Rodriguez, Aaron Chun, and Rayann Mollasgo—are due back in court on Jan. 29 for a status check. A new trial date has not yet been scheduled.
