  • Church says Texas town not standing by settlement reached for the McKinney Texas Temple – Deseret News


    The settlement that cleared the way for the construction of a temple in a Texas town by The Church of Jesus Christ of Latter-day Saints appears to be unraveling, according to statements by both sides.

    Now, the future of the McKinney Texas Temple may be headed to the courts if the agreement the town and the church reached in mediation in November doesn’t hold, a local church spokeswoman said in a new statement released Monday.

    Leaders in Fairview, Texas, denied the church’s original building application in August, after some residents complained the proposed temple was too large. The town and church forged a settlement in mediation after the church voluntarily agreed to reduce the size of the temple, dropping it from 44,000 square feet to 29,960 and from two stories to one. Church leaders also reduced the height of the proposed steeple from 173 feet.

    “Despite imposing a substantial burden on the church’s exercise and practice of religion, the church offered to make significant compromises, including reducing both the size of the temple by 10,000 square feet and reducing the height of the steeple to 120 feet,” the spokeswoman for the temple, Melissa McNeely, said in a statement.

    The mayor and town councilmembers unanimously agreed to approve the smaller temple, and the church began to prepare a new application.

    Why is the settlement now in question?

    But Fairview officials waffled publicly. Mayor Henry Lessner called the settlement an “initial compromise” in a letter announcing it to residents, then said at a Dec. 3 town meeting that negotiations were only in the first inning. Town officials also characterized the church as a bully during the meeting and asked residents to call church headquarters to ask for a still smaller temple, according to news reports.

    A town representative did just that the following day. According to a letter from a church attorney, an attorney for the town called him and asked for the church to accept a temple significantly smaller than the one the sides agreed to in mediation. Mayor Lessner then was quoted in the December town newsletter as saying, “through our attorneys, we have told (the church) that there is a good chance that the new design with the 120-foot tower will not be accepted.”

    On Dec. 20, the sides held a videoconference. According to the church attorney’s letter, Lessner told church representatives that while he and the mayor pro tem intended to vote for mediated settlement, they did not know how others would vote in wake of negative reaction from some residents.

    What will the church do next?

    Church officials planned to file their new application for the smaller temple on Jan. 13, but they became uncertain it would be accepted because of statements by the mayor and other town officials, according to the church attorney’s letter.

    “In light of the foregoing circumstances, the church has no confidence that the town will make good on its commitments as set forth in the memorandum,” the church attorney stated. “The church is further concerned that proceeding as though the town will make good on its commitments will simply prejudice the church’s legal rights. Accordingly, the church will not submit an amended or new conditional use permit application today.”

    Melissa McNeely, the temple spokeswoman, said the church had attempted to negotiate in good faith to find common ground while protecting the rights of religious freedom for local members of the church.

    “The church understood these modifications fully satisfied any concerns previously raised by the town council,” she stated.

    Attorneys representing the church asked Fairview officials to allow the church representatives to meet with each town councilmember individually. According to the church attorney, town officials said they would share the invitation with the councilmembers but did not expect all to agree.

    “If town officials continue to be unwilling to discuss the status of the agreement made in mediation,” McNeely stated, “the next step is to ask a court to review local, state and federal laws regarding the town’s process of denying the church’s original proposal in August 2024 to build a temple in Fairview, Texas.”

    Why the church believes it has the right to build the temple

    Temples are sacred, holy places for Latter-day Saints, who consider them to be houses of the Lord. Church officials have said from the beginning that federal and state religious liberty laws and Fairview zoning laws give the church the right to build the temple at the size proposed in its original application.

    “The Church of Jesus Christ of Latter-day Saints seeks to be a good neighbor and has an extensive track record of successfully building temples that have been welcomed in more than 200 communities around the world, including seven in Texas,” McNeely said in her statement. “These places of worship are always well maintained, feature beautiful landscaping and symbolize faith and peace.”

    The proposed location of the temple is on a four-lane highway directly across the street from businesses in a commercial zone in Allen, Texas.

    The Fairview side of the road is known as “church row” because four churches in a row line the street. Church representatives and attorneys have repeatedly noted that houses of worship traditionally are located in residential zones in the same way schools are. Fairview’s zoning ordinances uphold that practice, church representatives say.

    Legally, the church says the Texas Religious Freedom Restoration Act and the Religious Land Use and Institutionalized Persons Act, a federal law known as RLUIPA bar local governments from imposing unreasonable land-use requirements on people of faith building places of worship.

    The U.S. Department of Justice sent an official letter to state, county and municipal officials across the nation in March 2024, reminding them that, among other things, “RLUIPA prohibits governments from imposing or implementing land use regulations that ‘unreasonably limit’ religious assemblies, institutions or structures within a jurisdiction.”

    The letter noted that, “While zoning is primarily a local matter, where it conflicts with federal civil rights laws such as the Fair Housing Act or RLUIPA, federal law takes precedence.”

    Fairview officials have maintained that their zoning ordinances give them latitude to enforce limits on the church.

    New Georgia RLUIPA case

    The Justice Department noted in the March 2024 letter that it had opened over 155 formal investigations and filed nearly 30 lawsuits related to RLUIPA’s land-use provisions.

    It has continued to enforce those provisions. The department filed another lawsuit against a city on Dec. 16, when it alleged that the City of Brunswick, Georgia, violated RLUIPA by interfering with land owned by the United Methodist Church. The church runs The Well, a faith-based resource center for people experiencing homelessness on its land. The city has blamed the center for what the DOJ characterized as unrelated criminal activity in Brunswick, according to a DOJ news release.

    “Federal law protects the right of religious groups such as The Well to use their land to help others,” said Kristen Clarke, an assistant attorney general in the Justice Department’s Civil Rights Division, in a statement. “The division will continue to vindicate the rights of groups to exercise their religion and fight local land-use laws that unlawfully restrict those rights.”

    The DOJ has supported RLUIPA through both recent Republican and Democratic administrations.

    The Justice Department announced its Place to Worship Initiative in June 2018. The initiative focused on RLUIPA’s provisions that protect the rights of houses of worship and other religious institutions to worship on their land.

  • Companies are running away from DEI. One of America’s biggest beauty brands is standing firm

    Some of the biggest brands in America, including Amazon, Meta, Walmart and McDonald’s, have recently changed or ended their diversity, equity and inclusion (DEI) programs. But e.l.f. Beauty, a popular cosmetics brand, is a rare company vocally touting its diversity efforts and inclusive marketing like its “So Many Dicks” campaign.

    The provocative advertising campaign last year highlighted that nearly as many men named Richard, Rick or Dick served on public US company boards as women altogether.

    “There’s nothing wrong with being Richard, Rick or Dick, but we wanted to shine a light on ‘let’s give other people a chance’ because we’ve seen the benefits in our own business,” e.l.f. CEO Tarang Amin said in an interview last week with CNN. E.l.f is one of only two publicly traded companies with a board that’s more than 78% women and 44% people of color.

    E.l.f, which stands for “eye, lip, face” and sells at Walmart, Target and Walgreens is making the business case for diversity efforts at a moment when these initiatives are under attack across the country.

    DEI, or diversity, equity and inclusion, has become a dirty word on the right. Many companies are pulling back on DEI programs and socially driven marketing, fearful of becoming the next Bud Light. Bud Light’s parent company A-B InBev lost as much as $1.4 billion in sales because of backlash to Bud Light’s brief partnership with a transgender influencer.

    Other companies have altered DEI programs in response to opposition from right-wing activists, lawsuits from conservative legal groups, demand from conservative-leaning customers and other factors. President Donald Trump this week also placed employees in any federal diversity, equity, inclusion and accessibility offices on leave, and the Trump administration plans to take further aim at diversity programs.

    But E.l.f., based in Oakland, California, is standing behind DEI because it has an employee base and loyal following of younger, more diverse consumers that back its efforts.

    Representatives of e.l.f. rang the opening bell at the New York Stock Exchange in March. E.l.f. is one of two public companies with a workforce that is 78% women and 40% people of color.

    Comments like “I have never loved ELF more in my life!!!” poured in on Instagram in response to e.l.f’s “So Many Dicks” campaign. “I’m so proud of this brand,” another said. While the majority of social media posts were positive, support for the campaign wasn’t universal. Some people questioned what corporate board representation had to do with makeup and said e.l.f. should “leave politics and your opinions on social issues out of cosmetics.”

    E.l.f. has reaped the benefits of its strategy. The company has posted 23 consecutive quarters of sales growth, and its stock has increased by more 700% over the past five years.

    E.l.f. doesn’t have a DEI team, but its commitment to hiring a diverse workforce across gender, race, sexual orientation, nationality and other demographic lines has driven its success, Amin said. Around 75% of its roughly 500 employees are women and 40% are people of color. As part of e.l.f.’s diversity and inclusion strategy, the company also features transgender and non-binary models in advertising.

    “Diverse voices actually help us because they’re bringing different perspectives,” Amin, 59, said. Companies that abandon their diversity efforts risk losing out on “incredible talent that has different points of view and that add perspective to a company.”

    DEI is generally a mix of employee training, employee resource networks and recruiting practices to advance representation of different races, genders and classes, people with disabilities, veterans and other underrepresented groups. Opponents like Elon Musk say DEI represents “reverse racism” and has claimed that race now trumps all qualifications for hiring and promotions.

    Companies that have reversed DEI efforts sometimes are “succumbing to pressures” of anti-DEI sentiment, Amin said. “They’re reacting to one constituency.”

    E.l.f. does not risk as much backlash from its approach as other brands because it has a concentrated base of Millenial and Gen Z consumers that are likelier to support DEI efforts, said Anna Glassgen, an analyst who covers the brand at B. Riley Financial.

    E.l.f. is standing firm because it has a loyal customer base of Gen Z and Millennials that support its diversity efforts.

    Women, workers under 30 and minority employees are the most likely to say focusing on DEI at work is a good thing, according to 2023 polling from Pew Research Center.

    “The majority of folks who would complain about e.l.f.’s DEI perspective are not their target consumers,” said Jarvis Sam, a former chief diversity, equity and inclusion officer at Nike and the founder of The Rainbow Disruption, a DEI consulting firm. The beauty and cosmetics industry has long been scrutinized for a lack of diversity, and e.l.f.’s inclusive marketing efforts helped distinguish the brand from older, more established beauty lines such as Revlon, he said.

    CEO Amin also is not concerned about backlash to e.l.f.’s efforts, including from right-wing activists like Robby Starbuck.

    Starbuck, a former Hollywood music video director-turned-conservative activist, has caught fire campaigning online against major companies’ DEI programs and other progressive initiatives. He has targeted companies such as John Deere, Tractor Supply and others online and claimed credit for many of the changes they are making.

    Starbuck would be ill-advised to target e.l.f.’s diversity efforts, Amin said.

    “Our community is highly vocal and highly loyal, so it would be a mistake for him to start tweeting on that because they can be pretty vicious when people go against their beloved e.l.f.,” he said.

    Despite some companies’ changes, Amin also said CEOs and business leaders he speaks to are still committed to expanding diversity within their companies.

    “I think a lot is made out of this whole anti-DEI thing,” he said. “I think more people are committed to having more diverse workforces that are inclusive than there are people who are not.”

    Other companies are also defending DEI, such as Costco and Apple.

    Costco’s board of directors recently recommended that its shareholders vote against a proposal brought by a conservative think tank, the National Center for Public Policy Research, that would require Costco to report on the financial risks of maintaining its diversity and inclusion goals. The group criticized Costco for possible “illegal discrimination” against employees who are “white, Asian, male or straight.”

    Costco said its DEI efforts help the company attract and retain a wide range of employees and improve merchandise and services in stores. Costco also said its members want to interact with a diverse employee base.

    “Among other things, a diverse group of employees helps bring originality and creativity to our merchandise offerings, promoting the ‘treasure hunt’ that our customers value,” Costco said in its proxy statement to investors.

    Costco “framed it well in terms of when they have a more diverse workforce, they see better engagement,” Amin said. “It’s the same thing for us.”

Bud Light’s parent company A-B InBev lost as much as $1.4 billion in sales because of backlash to Bud Light’s brief partnership with a transgender influencer.

    Other companies have altered DEI programs in response to opposition from right-wing activists, lawsuits from conservative legal groups, demand from conservative-leaning customers and other factors. President Donald Trump this week also placed employees in any federal diversity, equity, inclusion and accessibility offices on leave, and the Trump administration plans to take further aim at diversity programs.

    But E.l.f., based in Oakland, California, is standing behind DEI because it has an employee base and loyal following of younger, more diverse consumers that back its efforts.

    Representatives of e.l.f. rang the opening bell at the New York Stock Exchange in March. E.l.f. is one of two public companies with a workforce that is 78% women and 40% people of color.

    Comments like “I have never loved ELF more in my life!!!” poured in on Instagram in response to e.l.f’s “So Many Dicks” campaign. “I’m so proud of this brand,” another said. While the majority of social media posts were positive, support for the campaign wasn’t universal. Some people questioned what corporate board representation had to do with makeup and said e.l.f. should “leave politics and your opinions on social issues out of cosmetics.”

    E.l.f. has reaped the benefits of its strategy. The company has posted 23 consecutive quarters of sales growth, and its stock has increased by more 700% over the past five years.

    E.l.f. doesn’t have a DEI team, but its commitment to hiring a diverse workforce across gender, race, sexual orientation, nationality and other demographic lines has driven its success, Amin said. Around 75% of its roughly 500 employees are women and 40% are people of color. As part of e.l.f.’s diversity and inclusion strategy, the company also features transgender and non-binary models in advertising.

    “Diverse voices actually help us because they’re bringing different perspectives,” Amin, 59, said. Companies that abandon their diversity efforts risk losing out on “incredible talent that has different points of view and that add perspective to a company.”

    DEI is generally a mix of employee training, employee resource networks and recruiting practices to advance representation of different races, genders and classes, people with disabilities, veterans and other underrepresented groups. Opponents like Elon Musk say DEI represents “reverse racism” and has claimed that race now trumps all qualifications for hiring and promotions.

    Companies that have reversed DEI efforts sometimes are “succumbing to pressures” of anti-DEI sentiment, Amin said. “They’re reacting to one constituency.”

    E.l.f. does not risk as much backlash from its approach as other brands because it has a concentrated base of Millenial and Gen Z consumers that are likelier to support DEI efforts, said Anna Glassgen, an analyst who covers the brand at B. Riley Financial.

    E.l.f. is standing firm because it has a loyal customer base of Gen Z and Millennials that support its diversity efforts.

    Women, workers under 30 and minority employees are the most likely to say focusing on DEI at work is a good thing, according to 2023 polling from Pew Research Center.

    “The majority of folks who would complain about e.l.f.’s DEI perspective are not their target consumers,” said Jarvis Sam, a former chief diversity, equity and inclusion officer at Nike and the founder of The Rainbow Disruption, a DEI consulting firm. The beauty and cosmetics industry has long been scrutinized for a lack of diversity, and e.l.f.’s inclusive marketing efforts helped distinguish the brand from older, more established beauty lines such as Revlon, he said.

    CEO Amin also is not concerned about backlash to e.l.f.’s efforts, including from right-wing activists like Robby Starbuck.

    Starbuck, a former Hollywood music video director-turned-conservative activist, has caught fire campaigning online against major companies’ DEI programs and other progressive initiatives. He has targeted companies such as John Deere, Tractor Supply and others online and claimed credit for many of the changes they are making.

    Starbuck would be ill-advised to target e.l.f.’s diversity efforts, Amin said.

    “Our community is highly vocal and highly loyal, so it would be a mistake for him to start tweeting on that because they can be pretty vicious when people go against their beloved e.l.f.,” he said.

    Despite some companies’ changes, Amin also said CEOs and business leaders he speaks to are still committed to expanding diversity within their companies.

    “I think a lot is made out of this whole anti-DEI thing,” he said. “I think more people are committed to having more diverse workforces that are inclusive than there are people who are not.”

    Other companies are also defending DEI, such as Costco and Apple.

    Costco’s board of directors recently recommended that its shareholders vote against a proposal brought by a conservative think tank, the National Center for Public Policy Research, that would require Costco to report on the financial risks of maintaining its diversity and inclusion goals. The group criticized Costco for possible “illegal discrimination” against employees who are “white, Asian, male or straight.”

    Costco said its DEI efforts help the company attract and retain a wide range of employees and improve merchandise and services in stores. Costco also said its members want to interact with a diverse employee base.

    “Among other things, a diverse group of employees helps bring originality and creativity to our merchandise offerings, promoting the ‘treasure hunt’ that our customers value,” Costco said in its proxy statement to investors.

    Costco “framed it well in terms of when they have a more diverse workforce, they see better engagement,” Amin said. “It’s the same thing for us.”

  • Cowboys one of last two teams standing in head coach search. Brian Schottenheimer is the favorite, but how did we get here?

    Eleven days have elapsed since the Dallas Cowboys announced they were moving on from head coach Mike McCarthy.

    The franchise has yet to name a successor.

    Dallas has interviewed four candidates, engaging in informal conversations with at least two more. One candidate, 2023-24 Cowboys offensive coordinator Brian Schottenheimer, is the furthest along the road to a job offer. But where do all the moving parts stand? Let’s break it down, with some of the biggest questions you might be asking.

    The Cowboys have formally interviewed Philadelphia Eagles offensive coordinator Kellen Moore, former New York Jets head coach Robert Saleh, former Minnesota Vikings head coach Leslie Frazier and Schottenheimer. Team owner and general manager Jerry Jones has also engaged in informal conversations with multiple NFL-adjacent names.

    Jones called University of Colorado head coach Deion Sanders the same day he parted ways with Mike McCarthy, though that seems more like a brilliant public relations stunt to shift the conversation from his belated firing than it does a formal courtship. Jones never formally interviewed Sanders, whom he has been close with since Sanders’ time playing for the Dallas Cowboys. Thursday, Jones also engaged in a conversation with former Seattle Seahawks head coach Pete Carroll. But that was not a formal interview. Even before news broke Friday morning that Carroll was taking the Las Vegas Raiders head coaching job, the Cowboys were “hyper focused” on building around Schottenheimer, a team source told Yahoo Sports. The search increasingly seems to be about how Schottenheimer’s staff and vision will look rather than whether he will get the opportunity.

    Yes, and yes? Sorry for the cop-out, but both are true. The NFL season ended nearly three weeks ago and the Cowboys remain coachless. This has proven costly in their pursuit of a head coach as well as in retaining some top assistants.

    On the head coaching level, five teams beat the Cowboys to the punch: The New England Patriots hired Mike Vrabel before Dallas even parted ways with McCarthy; the Chicago Bears hired Detroit Lions offensive coordinator Ben Johnson on Tuesday; and the New York Jets hired Lions defensive coordinator Aaron Glenn on Wednesday. By late Friday morning, Tampa Bay Buccaneers offensive coordinator Liam Coen was headed to the Jacksonville Jaguars while Carroll reached a deal with the Raiders. Johnson and Glenn each interviewed virtually with their future employers during their wild-card bye week, when the Cowboys were still in conversation with McCarthy. So the Cowboys “fell behind” if they wanted to recruit any of those three top candidates.

    They’ve lost multiple members of their coaching staff to other jobs, including special teams coordinator John Fassel to the Tennessee Titans.

    Only the New Orleans Saints still have an opening, which ironically could go to McCarthy. Dallas was the latest one to this race – will they also be the last to finish it?

    The league office has urged teams to slow down the hiring processes, both to decrease the number of quick firings and associated costly buyouts, as well as to increase playoff coaches’ ability to focus on their postseason game-planning. Drawn-out searches could increasingly become the norm. But there’s no denying the Cowboys’ options continue to dwindle the longer they wait.

    Schottenheimer did not formally interview with Jerry and Stephen Jones until after Frazier, Saleh and Moore’s rounds. The Jones family’s interest in exploring further hints at a desire to find something other than what they’d already heard. Schottenheimer is the only candidate whose conversation continued to a second day, though a source said whether that formally constituted a second interview or extended the first is semantics for a candidate already in town.

    Moore is not available for further (or in-person) conversation right now as his Eagles prepare to host the Washington Commanders in the NFC championship game.

    What does Schottenheimer offer? The son of longtime head coach Marty Schottenheimer, Brian spent 14 years as offensive coordinator for the Jets, then-St. Louis Rams, Seahawks and Cowboys. He has coached in the NFL for 25 of the past 28 seasons. He joined the Cowboys in 2022 as a defensive consultant helping then-coordinator Dan Quinn anticipate opposing defenses’ trends. He was promoted to offensive coordinator before the 2023 season, though McCarthy called plays in the two years that followed.

    With McCarthy, Schottenheimer helped install a version of the West Coast offense that the Cowboys deemed the “Texas Coast” offense. Precision replaced creativity, with receiver route depths now tied to quarterback footwork with less room for improvisation. Protection schemes shifted, too.

    Results varied. The Cowboys led the league in scoring in 2023, ranking fifth in total offense. Prescott finished second in MVP voting to Baltimore Ravens quarterback Lamar Jackson. The following year with the same staff and similar personnel, Dallas’ offense fell to 17th, scoring to 21st.

    Prescott suffered a season-ending hamstring injury in November but the problems — with protection, establishing a run game and generating consistent passing — predated his injury. A year after throwing a league-best 36 touchdowns to just nine interceptions, he passed for 11 TDs to eight interceptions in eight games.

    Schottenheimer did coordinate top-10 offenses each of his past three seasons as a play-caller in Seattle from 2018-20. His pulse of the Cowboys’ interpersonal dynamics, understanding of Prescott’s strengths and, quite frankly, availability seem to be catching the Jones family’s attention.

    Increasingly, Schottenheimer seems like a done deal. But Moore checks a lot of boxes and impressed Cowboys brass in his interview as a coach who has matured in his vision for team-building since he left two years ago, a team source said.

    Moore’s Cowboys’ familiarity runs deep: He was Prescott’s backup quarterback, quarterbacks coach and then offensive coordinator from 2016-22. Moore has called plays in the NFL each of the past six years, leading the Cowboys to top-six offenses three of his four years and top-11 in scoring during those campaigns. The Cowboys ranked first overall in both marks in 2021 under Moore.

    In Philadelphia this season, Moore coordinated the seventh-best offense and eighth-best scoring attack. Quarterback Jalen Hurts’ passing game has been inconsistent, but Moore has responded by tipping his play calls toward a run game anchored by Saquon Barkley and one of the league’s best offensive lines.

    Moore is less extroverted than Schottenheimer but more widely regarded as a play-caller who is adapting to league trends with his creative uses of tempo and personnel-specific game plans to stress opposing play-callers. An AFC GM and an AFC executive from two teams who interviewed Moore in recent cycles each told Yahoo Sports they would not be concerned about his ability to command a room. The executive cited Moore’s emotional intelligence as strong enough to motivate the team; the general manager said leadership comes in multiple forms, and multiple cerebral offensive coaches in the league have succeeded. Often, those coaches hire a fiery defensive coordinator to balance out the energy.

    Seventeen-year Cowboys tight end Jason Witten hasn’t yet coached beyond the high school level. But he piqued Jones’ interest enough to warrant buzz around Witten’s candidacy as a head coach, much less a member of the next coaching staff. Jones has strong-armed candidates onto Cowboys staffs before, including Moore sticking around as McCarthy’s offensive coordinator in 2020. Witten’s move isn’t a done deal, but think of it like Jones views him as a valve to pull if it makes sense — perhaps because the head coaching pick isn’t as dynamic a presence as the Cowboys seek.

    While Sanders is unlikely to meaningfully resurface for several reasons, including the cost of his Colorado buyout, don’t be surprised if Jones spends time with him at next week’s East West Shrine Bowl. Sanders’ son, Shedeur, will compete at quarterback in a series of practices taking place at the Cowboys’ facility. Be prepared for Deion Sanders and Jones to converse … and generate speculation, warranted or not.

    The top two candidates are coordinators intimately familiar with Prescott. That shouldn’t be a surprise. The Cowboys’ biggest salary-cap investment, by far, is the record-setting extension they awarded Prescott in September hours before their season opener. Prescott is set to earn $240 million over four years, or $60 million per year. Any coaching candidate without a vision for his success should not seriously be considered.

    That vision could differ; multiple successful NFC teams, from the San Francisco 49ers to the Eagles, have recently maximized their quarterback with strong run games and offensive line play rather than an insistence on a highly paid player throwing the ball across the board.

    The 49ers represented the NFC in the Super Bowl last year. The Eagles enjoyed the honor the year before. And with the Cowboys’ NFC East rivals facing off in the conference championship, the franchise’s 30-year NFC title game drought — much less Super Bowl victory drought — stings even more.

    With the Commanders snapping their 34-year streak since advancing past the divisional round, every NFC team but the Cowboys have qualified for the conference title game since the 2010 season.

    The Cowboys’ last season in that position: 1995.

    They hope their next coach will change that.
